Sanford and Paul A. Vick and wife, Marsha C. Vick.

WITNESSETH: WHEREAS, Terry Sanford and wife, Margaret R. Sanford are the owners of a tract of land conveyed to them by Duke University by deed recorded in Book 986, Page 84, Durham County Registry; and, WHEREAS, Paul A. Vick and wife, Marsha C. Vick are the owners of a tract of land conveyed out of said tract of land originally conveyed from Duke University to Terry Sanford, Sr. and Margaret R. Sanford and being all of that property designated Tracts "A", "B" and "C" on plat and survey entitled "Property of Paul A. and Marsha Vick", prepared by The John R. McAdams Company, dated November 21, 1983, and now on file in the office of the Register of Deeds of Durham County in Plat Book 104, Page 87; and, WHEREAS, Duke University by Quitclaim Deed conveyed to Terry Sanford, Sr. all of the unopened part of Auburn Street, lying east of the limit of city maintenance by deed recorded in Book 1086, Page 136, Durham County Registry; and, WHEREAS, Terry Sanford, Sr. and wife, Margaret R. Sanford and Paul A. Vick and wife, Marsha C. Vick desire to set forth this driveway maintenance agreement made and entered into between them for the unopened part of Auburn Street, lying east of the limit of city 04328 -1980 من www.

NOW, THEREFORE, Terry Sanford, Sr. and wife, Margaret R. Sanford and Paul A. Vick and wife, Marsha C. Vick hereby declare that they have agreed and are bound to the other of them to pay for one-half (¹) of the cost of the maintenance of the unopened part of Auburn Street, lying east of the limit of city maintenance and this declaration shall run with the real property described and referred to herein and be binding upon all parties having any right, title or interest in the property described or referred to herein or any part thereof, their heirs, successors, assigns, devisees and legal and personal representatives and shall inure to the benefit of each owner thereof.
