AMENDMENT TO THE DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS OF BRYSON SPRINGS PHASE I & I This Amendment to the Declaration of Covenants, Conditions, Restrictions and Easements for Bryson Springs Phase I & II (this “Instrument”) is executed by JHDMC Limited Liability Company, a Texas limited liability company ("Declarant"), and amends the Declaration of Covenants, Conditions, Restrictions and Easements for Bryson Springs Phase I & II (the "Original Declaration") recorded at Clerk's Instrument Number 1632592 of the Official Public Records of Ellis County, Texas.

A. Recitals 1. Bryson Springs Phase I & II is a development located in Ellis County, Texas, consisting of real property described in the Original Declaration and in one or more plats of records in the Map or Plat Records, Ellis County, Texas as referenced in the Original Declaration.

2. This Instrument is executed by JHDMC Limited Liability Company, in its capacity as Declarant under the Original Declaration.

3. This Instrument is executed by Declarant pursuant to Article 12.1 of the Original Declaration, providing that so long as Declarant owns at least one Lot (as defined in the Original Declaration), the Original Declaration may be amended by Declarant, and no other Owner (as defined in the Original Declaration) shall have a vote regarding such amendment.

4. As of the execution and recording of this Instrument, Declarant owns at least one Lot.

B. Amendment to Original Declaration 5. Section 7.5(a) of the Original Declaration is hereby deleted in its entirety and replaced with the following: 7.5 Capitalization of Association — Payment.

a) Each Owner (other than Declarant [or a Builder]) of a Lot will pay a contribution to the Association (the "Initial Contribution"), which

a) Each Owner (other than Declarant [or a Builder]) of a Lot will pay a contribution to the Association (the "Initial Contribution"), which amount shall be due immediately upon the transfer of title to the Lot.

Upon the purchase/resale of a Lot from Declarant or another Builder or an occupying owner, the Initial Contribution initially shall be $300. This fee will be charged each and every time the lot/home is sold (if the Association is in existence).
