WITNESSETH: WHEREAS, the real property described in Exhibit A attached hereto (hereinafter the "Property") is currently subject to those certain Protective Covenants recorded in Book 5297, Page 354, Durham County Registry; and WHEREAS, the owners of most of the several lots in the Crestfield Subdivision, finding the aforementioned Protective Covenants to be deficient in many respects, have heretofore recorded in Book 7224, Page 196, Durham County Registry, that certain AMENDED AND RESTATED DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR CRESTFIELD (hereinafter the “Declaration"); and WHEREAS, the Declaration purported to subject the Property to the Declaration and to the jurisdiction of the CRESTFIELD OWNER'S ASSOCIATION, INC.; and WHEREAS, the previous owner of the Property executed the Declaration prior to transferring the Property to Owner, but due to delay, the Declaration was not filed of record until after the conveyance

1 Book7645 - Page626 Page 2 of 4 NOW, THEREFORE, in consideration of the premises, Owner hereby consents to the Declaration and declares that the real property identified and described on Exhibit A attached hereto and made a part hereof shall be and hereby is made subject to the Declaration and to the jurisdiction of the Crestfield Owners Association, Inc.
Said Property shall be owned, held, transferred, sold, conveyed, given, donated, devised, inherited, leased, occupied and used subject to the covenants, restrictions, conditions, easements, charges, assessments, affirmative obligations and liens (hereinafter the "Covenants and Restrictions") contained in the Declaration, which Covenants and Restrictions shall run with the land and be binding on all parties having or acquiring any right, title and interest in the Property or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof.
Declarant joins in the execution of this Supplement for the sole purpose of expressing its consent to the terms thereof.
