NOW, THEREFORE, pursuant to Article XI, Section 10, of the Declaration, the Declarant does hereby publish and declare that the property described hereafter and the improvements located thereon and all other improvements constructed thereon is held and shall be held, conveyed, hypothecated, encumbered, used, occupied and improved subject to the Covenants, Conditions and Restrictions of Eagles Pointe as recorded in Real Estate Book 2477, Page 504, Durham County Registry, such property being more particularly described as follows: BEING all of Lots 12 through 39 and Lots 91 through 116, as shown on that certain plat and survey entitled "EAGLES POINTE - PHASE 2" dated

, such property being more particularly described as follows: BEING all of Lots 12 through 39 and Lots 91 through 116, as shown on that certain plat and survey entitled "EAGLES POINTE - PHASE 2" dated 9/20/99, prepared by Triangle Surveyors, recorded in Plat Book 144, Page 135, Durham County Registry, to which plat reference is hereby made for a more particular description of same.
