Chicken Raising Policy § 880 THE STATE OF TEXAS COUNTY OF MONTGOMERY § WHEREAS, the Emerald Lakes Property Owners Association, Inc. (the "Association"), a Texas non-profit corporation, is the governing entity for the Emerald Lake subdivision, according to the map or

RY § WHEREAS, the Emerald Lakes Property Owners Association, Inc. (the "Association"), a Texas non-profit corporation, is the governing entity for the Emerald Lake subdivision, according to the map or plat thereof recorded under Clerk's File No. 2007-036606, along with any supplements or additions thereto; and WHEREAS, the Association is governed by the Emerald Lakes Declaration of Covenants, Conditions and Restrictions (the "Declaration"), as recorded in the Real Property Records of Montgomery County, Texas, under Clerk's File No. 2007-036741, along with any amendments and supplements thereto; and WHEREAS, Section 204.010 of the Texas Proprety Code authorizes the Association through its Board of Directors to regulate the use, maintenance, repair, replacement, modification, and appearance of the Subdivision; and WHEREAS, Article XII, Section 4 of the Declaration authorizes the Association through its Board of Directors, to make and enforce reasonable rules and regulations governing the use of the Subdivision consistent with the rights and duties established by the Declaration; and NOW THEREFORE, in accordance with the foregoing, the Association acting through its Board of Directors, hereby adopts, establishes and imposes the following Chicken Raising Policy as outlined herein: CHICKEN RAISING POLICY Chickens 1. No roosters are allowed.

2. A maximum of 6 female chickens are allowed per home site.

3. Chickens are not allowed to roam freely on property. They must be confined within a coop/run facility at all times unless under the direct control of the owner.

Coops and Runs 1. Coops/runs must be located to the rear of the main dwelling, concealed from front street and adjacent views, and located outside of all building setbacks.

2. Coops/runs can be located no closer than 50 feet to any creek, pond or lake regardless of the building setback. Care should be taken to not allow contaminated water discharge from entering the waterways.

3. Only one small animal coop/run per home site is allowed.

4. Facility should be sized to allow at least 3 square feet of coop space and 10 square feet of run space per hen.

5. Coops and runs should be enclosed, well ventilated and kept clean and sanitary as to not cause an odor or visual nuisance. Hens are not to create a noise nuisance. See Article VI. Paragraph K.
