DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR SKYLINE RANCH, FORT WORTH, TEXAS STATE OF TEXAS COUNTY OF TARRANT KNOW ALL MEN BY THESE PRESENTS: THIS SECOND AMENDMENT TO THE DECLARATION OF COVENANTS.
CONDITIONS AND RESTRICTIONS FOR SKYLINE RANCH. FORT WORTH.
TEXAS (this "Second Amendment") is made by FW SKYLINE RANCH RESIDENTIAL ASSOCIATION, INC. as of the 12 2015.
"day of June WITNESSETH: WHEREAS, Declarant executed that certain Declaration of Covenants, Conditions and Restrictions for Skyline Ranch, Fort Worth, Texas, dated March 6, 2007, recorded in the Official Public Records of Real Property of Tarrant County, Texas, under Document No. D207082551 and the First Amendment to Declaration of Covenants, Conditions and Restrictions for Skyline Ranch, Fort Worth, Texas, dated February 3, 2010, recorded in the Official Public Records of Real Property of Tarrant County, Texas, under Document No. D210056745 (collectively the “Declaration"); and WHEREAS, Section 12.02 of the Declaration provides that during the time Declarant is the owner of a Lot. Declarant may amend the Declaration with the consent of at least seventy percent (70%) of the Owners of Lots subject to the Declaration; or the Declaration may be amended or changed upon the express written consent of Members and Owners entitled to cast as at least seventy percent (70%) of the total outstanding votes under the Declaration; and WHEREAS, in compliance with the terms of the Declaration, notice was given to all
nd Owners entitled to cast as at least seventy percent (70%) of the total outstanding votes under the Declaration; and WHEREAS, in compliance with the terms of the Declaration, notice was given to all Owners and Members of this proposed Second Amendment; WHEREAS, after notice was given to all Owners and Members, at least seventy percent (70%) of the Owners of Lots subject to the Declaration; or at least seventy percent (70%) of the Members and Owners entitled to cast votes under the Declaration agreed in writing to this Second Amendment; and WHEREAS, Declarant consented to the amendment of the Declaration; WHEREAS, capitalized terms not defined in this Second Amendment shall have the meanings given to such terms in the Declaration; WHEREAS, Article IX, Paragraph 9.14 of the Declaration of Covenants and Restrictions for Skyline Ranch, Fort Worth, Texas is deleted in its entirety and replaced with a new Article IX, Paragraph 9.14 that now reads as follows: 9.14 Each Lot shall have a two inch (2") caliper tree (the "yard tree") installed in the front yard. Any and all plans for landscaping of front yards not enclosed by solid fencing, including alterations, changes or additions thereto, shall be subject to the written approval of the Architectural Control Committee. Each Lot shall be fully landscaped prior to completion. Each Lot Owner shall be responsible for watering and maintaining his own lawn (including the parkway adjacent to his Lot) and maintaining the landscaping in a SECOND AMENDMENT TO COVENANTS, CONDITIONS AND RESTRICTIONS - Page 1 Page 2 of 2 healthy and attractive condition.
The Declaration, as expressly modified herein, remains in full force and effect and is hereby ratified and confirmed.
