SECOND AMENDMENT TO COVENANTS, CONDITIONS AND RESTRICTIONS - Page 2 additions thereto, shall be subject to the written approval of the Architectural Control Committee. Each Lot shall be fully landscaped prior to completion. Each Lot Owner shall be responsible for watering and maintaining his own lawn (inclu ding the parkway adjacent to his Lot) and maintaining the landscaping in a healthy and attractive condition.

NOW, THEREFORE, Article IX, Section 9.14 Landscaping of the Declaration is hereby amended and restated in its entirety to read as follows: Each Lot shall have at least one (1), three inch (3”) caliper tree (the “ street tree ”) installed in the area between the sidewalk and the street curb and another two inch (2”) caliper tree (the “yard tree ”) installed in the front yard so that the spacing b etween the two (2) trees is at least twenty -five feet (25’). Corner Lots shall require three (3) trees. In addition to the street tree, Corner Lots shall require two (2) three inch (3”) caliper trees to be installed along the side street frontage general ly equidistant and at least twenty -five feet (25’) apart in the area between the sidewalk and the street curb. Corner Lots shall not require one of the three trees to be considered a yard tree as defined above . Any and all plans for landscaping of front yards and of side yards not enclosed by solid fencing, including alterations, changes or additions thereto, shall be subject to the written approval of the Architectural Control Committee. Each Lot shall be fully landscaped prior to completion.
