MOIS ST 4 JOINDER AND CONSENT TO SUPPLEMENTARY DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOXWOOD ADDITION ‘ THE STATE OF TEXAS KNOW ALL BY THESE PRESENTS: tO > Un COUNTY OF SMITH THIS JOINDER AND CONSENT TO SUPPLEMENTARY DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS (the “Joinder’’) is made by J. Wilson Custom Homes, Ltd., a Texas limited partnership (“Owner’’), and is as follows: RECITALS: A. Owner is currently the fee owner of Lot 21, Foxwoop ApDITION, UNIT 2, a subdivision of record in Smith County, Texas, according to the map or plat thereof recorded in Cabinet D, Slide 379-A of the Plat Records of Smith County, Texas (the “Annexed Loft’).

B. Pursuant to Article II of that certain Declaration of Covenants, Conditions and Restrictions — Foxwood Addition, recorded in Volume 7596, Page 902, under Document No.

2004-R0045348 of the Official Records of Smith County, Texas, as amended by First Amendment to Declaration of Covenants, Conditions and Restrictions — Foxwood Addition, recorded under County Clerk’s File No, 2010-R00058121 of the Official Records of Smith County, Texas (as amended, the “Declaration”), Declarant has the right to add or annex additional real property into the scheme of the Declaration by filing of record a supplementary declaration, executed and recorded in accordance with Article I of the Declaration.

C. Pursuant to Supplementary Declaration of Covenants, Conditions and Restrictions ~ Foxwood Addition, executed and recorded in the Official Records of Smith County, Texas of even date herewith (the “Supplementary Declaration”), Declarant annexed into the Declaration all real property located within Foxwood, Unit 2, and Owner hereby desires to join in and

County, Texas of even date herewith (the “Supplementary Declaration”), Declarant annexed into the Declaration all real property located within Foxwood, Unit 2, and Owner hereby desires to join in and consent to the Supplementary Declaration for purposes of annexing the Annexed Lot.

Now, THEREFORE, in consideration of the premises and for the mutual rights and benefits to be derived by Owner pursuant to the Declaration, Owner hereby joins in and consents to the Supplementary Declaration. Owner does hereby acknowledge and agree, for itself and its successors and assigns, that the Annexed Lot shall be held, sold, conveyed, and occupied subject to all easements, restrictions, covenants, terms, and conditions set forth in the Declaration and Supplementary Declaration.
