PREPARED BY AND MAIL TO MAUPIN, TAYLOR, ELLIS & ADAMS POST OFFICE BOX 19764 RALEIGH, NORTH CAROLINA 27619 NORTH CAROLINA BOOK 1642PAGE 655 BOOK NOTED DURHAM COUNTY DECLARATION OF ANNEXATION of HOMEPLACE IV, SECTION SEVEN WHICH INCLUDES LOTS 7, 8 AND 9, AND COMMON AREA, INTO HOMEPLACE IV THIS DECLARATION OF ANNEXATION, made on this 4th day of March, 1991, by Hoying Huff, Inc., a North Carolina corporation, hereinafter referred to as "Declarant"; WITNESS ETH: THAT WHEREAS, Declarant has heretofore executed and caused to be recorded an instrument entitled "Declaration of Protective Covenants and Conditions for Homeplace IV, Section having been recorded in Book 1443, page 95, Durham County Registry, said document being referred to herein as the One, " "Declaration"; and WHEREAS, Article II, Section 2 of the Declaration, provides that Declarant, may annex to the Properties the additional lands described in Section 2 of Article II of the Declaration by recording in the Durham County Registry a declaration of annexation, duly executed by Declarant, describing the lands annexed and incorporating the provisions of the Declaration, either by reference or by fully setting out said provisions therein. The additional lands shall be deemed annexed to the Properties on the date of recordation of the declaration of annexation, and no action or consent on the part of the Association or any other person or entity shall be necessary to accomplish the annexation; and 03103 1050 BOOK 1642PAGE 656 WHEREAS, Declarant desires to annex to the Properties and all of Section Seven, Homeplace IV, which includes Lots 7, 9, inclusive, and Common Area, as described in the attached Exhibit "A", said area lying within the perimeter of the lands

the Properties and all of Section Seven, Homeplace IV, which includes Lots 7, 9, inclusive, and Common Area, as described in the attached Exhibit "A", said area lying within the perimeter of the lands which the Declarant is entitled to annex pursuant to authority contained in the Declaration as amended; NOW, THEREFORE, Declarant hereby declares that all of Section Seven, Homeplace IV, which includes Lots 7, 8 and 9, inclusive and Common Area, as shown on a map entitled "HOMEPLACE IV, SECTION SEVEN, LOTS 7 THROUGH 9," further described in attached Exhibit "A" are hereby annexed to the Properties as permitted by the Declaration, whereby all of the foregoing areas are now subject to the terms, requirements and conditions of the Declaration, and are entitled to all of the benefits of the Declaration.
