ASSESSMENT COLLECTION POLICYThe Home Place atIarrell isacommunity (the”Community”) created byandsubject totheAmended and Restated Declaration ofCovenants, Conditions, and Restrictions, recorded underDocument No. 2018002205, intheOfficial Public Records ofWilliamson County, Texas, asitmaybe amended (“Declaration”). The operation oftheCommunity isvested inThe Home Place atIarrell Homeowner’s Association, Inc.(the ”Association"), acting through itsboard ofdirectors (the”Board”).
The Association isempowered toenforce the covenants, conditions and restrictions of theDeclaration, theBylaws andrules oftheAssociation (collectively, the”Documents”), includingthe obligation ofOwners topay Assessments pursuant totheterms and provisions oftheDeclaration.
The Board hereby adopts thisAssessment Collection Policy toestablish equitable policiesand procedures forthecollection ofAssessments levied pursuant totheDeclaration. Words andphrases used inthispolicy have thesame meanings given tothem bytheDeclaration.

A Special orDeficiency Assessment payable ininstallments may beaccelerated only after the Association gives theOwner atleast fifteen (15) days prior notice ofthedefault and the Association’s intent toaccelerate theunpaid balance ifthedefault isnottimely cured.Following acceleration oftheindebtedness, theAssociation hasnoduty toreinstate theinstallment program upon partial payment bytheOwner.
SECTION 3.PAYMENTS Application ofPayments. Any payment received bytheAssociation willbeapplied inthefollowing order, starting with theoldest charge ineach category, until that category isfully paid, regardless oftheamount ofpayment, notations onchecks, and thedate theobligations arose:(1) any delinquent assessment.(2) any current assessment.

Notwithstanding thecontents ofthisdetailed policy, theofficers, Directors, manager, and attorney ofthe Association will exercise their independent,collective, andrespective judgment inapplying thispolicy.

AnOwner may request inwriting ahearing bytheBoard todiscuss andverify facts andresolve theViolation. Torequest ahearing before theBoard, theownermust submita written request totheAssociation’s manager (ortheAssociation’s board ofdirectors ifthere isnomanager) onorbefore the30thdayafter thedate theviolationnotice was mailed totheOwner. The Board shall notify theOwner ofthedate, time, andplace ofthehearing notlater than thetenth (10)daybefore thedate ofthehearing. TheBoard ortheOwner may request apostponement, and, ifrequested, apostponement shallbe granted foraperiod ofnotmore than ten(10)days. Additional postponements may begranted byagreement oftheparties. TheOwner ortheAssociation may make anaudiorecording ofthemeeting. The hearing will bescheduled toprovide areasonable opportunity forboth theBoard and theOwner toattend. The hearing will beheld ina closed orexecutive session oftheBoard. Atthehearing, theBoard will consider the

Ifthefineislevied atthe hearing atwhich theOwner isactually present, thenotice requirement will besatisfied iftheBoard announces itsdecision tothe Owner atthehearing. Otherwise, the notice must beinwriting. Inaddition tothe initial levy notice, the Association willgive theOwner periodic written notices ofanaccruing fine ortheapplication ofan 10.OWner’s payments toreduce thefine. Theperiodic notices may beintheform ofmonthlystatements ordelinquency notices.Amount.

COVENANT ENFORCEMENT POLICY Covenant Enforcement. TheAssociation shall have thepower toassess fines against an Owner forviolations ofany restriction setforth intheDeclaration, Bylaws, Architectural Committee Rules (ifany), oranyAssociation Rules adopted bytheBoard which have been committed byanOwner, anoccupant oftheOwner’s Lot, ortheOwner oroccupant’s family, guests, employees, contractors, agents orinvitees.

The procedure forassessment offines and damagecharges willbeasfollows:(1) theAssociation, acting through anofficer, Board member ormanaging agent, must give theOwner notice ofthefine ordamage charge notlaterthan thirty (30)days after theassessment ofthefineordamage charge bythe Board; (2) thenotice ofthefine ordamage charge must describe theviolation ordamage; (3) thenotice ofthefineordamage charge must state theamount ofthefineor damage charge;(4) thenotice ofafineordamage charge must state that theOwner willhavethirty (30)days from thedate ofthenotice torequest ahearing before the Board tocontest thefineordamage charge; and(5) thenotice ofafinemust allow theOwner areasonable time, byaspecified

Fine and/0r damage charges aredue immediately after theexpiration ofthe thirty (30)dayperiod forrequesting ahearing. Ifahearing isrequested,such fines ordamage charges will bedue immediately after theBoard'sdecision atsuch hearing, assuming that afineordamage charge ofsomeamount isconfirmed bytheBoard atsuch hearing. The payment ofeachfine and/or damage charge levied bytheBoard against theOwner ofaLotis, together with interest thereon and allcosts ofcollection, includingattorney’s fees asherein provided, secured bythelien granted totheAssociation pursuant totheDeclaration.BHl-X-X@CERTIFICATION 8:ACKNOWLEDGMENT AstheSecretary ofThe Home Place atJarrell Homeowners Association, Inc.
