LT1-1-2012016644-1 AMENDMENT TO THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR INDIGO RANCH STATE OF TEXAS COUNTY OF MONTGOMERY § KNOW ALL MEN BY THESE PRESENTS This Amendment to the Corrected Declaration of Covenants, Conditions, and Restrictions for Indigo Ranch, Montgomery County, Texas dated April 22, 1999, Montgomery County clerks file number 99031192, "Restrictions', is made on the date hereinafter set forth by INDIGO RANCH Property Owners' Association, hereinafter referred to as "Association”, in accordance with Chapter 204 of the Texas Property Code.

WITNESSETH WHEREAS, "Indigo Ranch" is a Subdivision of 520.178 acres of land situated in the Alex Barron Survey, A-93, S.J. McFarland Survey, A-363, the George H. Bringhurst Survey, A-86 and the Peter Mitchell Survey, A-378, Montgomery County, Texas according to the plat ("Plat") of said Indigo Ranch, recorded in the office of the County Clerk of Montgomery County, Texas on the 31st day of March, 1999, after having been approved as provided by law, and being recorded in Cabinet L, Sheet(s) 175-178, of the Map Records of Montgomery County, Texas (hereinafter referred to as the "Property" or the "Subdivision"); and WHEREAS, Association is a non profit corporation, incorporated under Texas Non-Profit Corporation Act, (Tex. Civ. Stat. Ann. Article 1396-1.01 et seq.) an in accordance with the aforementioned restrictive covenants; and WHEREAS, it is the desire of Association to amend the Restrictions upon and against such Property in order to establish a uniform plan for the development, improvement and sale of the Property, and to insure the preservation of such uniform plan for the benefit of both the present and future owners of Lots in said Subdivision;

m plan for the development, improvement and sale of the Property, and to insure the preservation of such uniform plan for the benefit of both the present and future owners of Lots in said Subdivision; NOW THEREFORE, The property owners of Indigo Ranch have approved by petition an amendment to Article III, Section 3.07 of the Restrictions, (see Petition attached hereto). Association hereby adopts, establishes and imposes upon the Property and Subdivision known as Indigo Ranch an amendment to the Restrictions as follows: LT2-9 AMENDMENT Article III, Section 3.07 Water Supply, is hereby amended, changed and rewritten in its entirety to read as follows: The primary water supply in this Subdivision shall be a central fresh water system provided by a private water company and shall offer service to all dwellings. The central water system shall be operated and maintained with applicable governmental requirements. Owners using the central system shall be required to pay charges for connection or use of water from said system.

A private well may be installed on a property owner's lot as a source of water for personal use only.

Private wells may be used by an owner to provide all potable and non-potable water needs or, an owner may limit the use of a private well to non-potable uses such as irrigation and use the central water system for household needs. Private water wells may be installed in the common areas by the Property Owners' Association. There shall be no connection between any private well and the central water system which allows water to be returned to the central water supply.

Any private well installed in the subdivision, shall be approved by the Architectural Control Committee (ACC) and any required governmental authorities and shall meet ACC guidelines and

New Reas Notary Public MINUTES OF SPECIAL MEETING OF THE BOARD OF DIRECTORS OF INDIGO RANCH PROPERTY OWNERS' ASSOCIATION A Special Meeting of the Board of Directors of INDIGO RANCH Property Owners' Association (the Texas on 8/21/11 "Association"), was held at 17702 Indigo Hills Dr. Magnolia.

Charles Lieder Anne Christie, President of the Association, called the meeting to order and stated that the meeting had been called in accordance with the Bylaws of the Association. Susic Waits acted as Secretary of the meeting.

The Chairman/President then announced that meeting was called to consider the following: approval of amendment to the declaration of covenants, conditions and restrictions for Indigo Ranch. After discussion and motion duly made, seconded and carried, it was: RESOLVED, that the Board approves the amendment to Article III, Section 3.07 Water Supply as stated in the attached Exhibit "A" and has authorized the circulation of the petition.

There being no further business to come before the Board of Directors, on motion duly made, seconded and carried, the meeting was adjourned.
