King’s Country Property Owners Association Nuisance Dog Policies Barking Dog Policy: 1. The affected property Owner should first contact the dog Owner and attempt to resolve the problem between the parties.

2. If the problem is not resolved, the a ffected property Owner may notify the KCPOA Property Manager or a member of The Board.

3. The KCPOA Property Manager will then evaluate the situation to determine if it meets the criteria to be deemed a nuisance. Excessive barking shall be defined as a nuisance if it is frequent, regular, habitual or continuous for a period of at least fifteen (15) minutes; or occurring after 10:00 p.m. but before 6:00 a.m.

4. If the situation is deemed a nuisance by the Property Manager, then the Property Manager will notify the dog Own er in person if possible and by letter to inform the dog Owner of the ruling. The dog Owner will be given two (2) weeks to resolve the situation.

If the nuisance still exists after two (2) weeks, then, with The Board’s approval, the dog Owner will be fin ed according to the fine schedule listed below.

Nuisance determinations made by the Property Manager may be appealed by the dog Owner to The Board. Nuisance determinations made by The Board will be final.

Loose or Unmanaged Dog Policy: KCPOA has ado pted a zero -tolerance policy for loose or unmanaged dogs due to the risk of injury to KCPOA residents and their guests. Section 4.06 of the KCPOA Covenants, in part, says “Pets must be confined to the Owner’s premises inside the home or inside a fenced area (electric fences are acceptable) or on a leash. No pet will be permitted to run at large. No animals shall be permanently chained.”

A dog wearing a n electronic collar and under the immediate supervision and control of the owner is an acceptable mea ns of confinement to the Owner’s premises and is also an acceptable alternative to using a leash.

A sign is posted on the KCPOA bulletin board near the entrance to King’s Country as a continuous reminder of this zero -tolerance policy.

Owners who violate this policy, or allow their guests to violate this policy, will be fined according to the fine schedule listed below .

For willful and intentional disregard of this zero -tolerance policy by an Owner , The Board may vote to impose a fine greater than those listed in the fine schedule in response to the first or any subsequent violations.

Fine Schedule for Nuisance Dog Policies: The property Owner will be notified with a letter of Non -Compliance , issued by certified mail , giving a time pe riod to resolve the issue.

The first (1st) notification will include a $200 fine .

The second (2nd) notification will include a $500 fine.

The third (3rd) notification will include a $1,000 fine.

Failure to resolve the non -compliance after the third (3rd) notification/fi ne may result in legal actions , at the discretion of The Board .
