SEVENTH AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS. FOR LAS PALMAS LUXURY TOWNHOMES This Amendment to Declaration of Covenants, Conditions, and Restrictions for Las Palmas Luxury Townhomes (the “Amendment”) is made by Las Palmas Luxury Townhomes Association, Inc. (the “Association”), a Texas nonprofit corporation, and‘is as follows: RECITALS: A. WHEREAS, the Las Palmas Luxury Townhome Subdivision (the “Subdivision”) was established and is governed by that certain Declaration of Covenants Conditions, and Restrictions for Las Palmas Luxury Townhomes recorded under Document 2006037882 of the Official Public Records of Nueces County, Texas, as amended and supplemented from time to time, collectively (the "Declaration"); B. WHEREAS, the Declaration establishes the Association and grants it the authority to manage and govern the Subdivision; Cc. WHEREAS, the Association wishes to amend and supplement Article IX, Section 10(13){d) of. the Declaration to better manage the pet regulations within the Subdivision; and D. WHEREAS, Section 209.0041(h) of the Texas Property Code provides that a declaration may be amended by a vote of at éast sixty-seven percent (67%) of the total votes allocated to members of a property. ‘owners’ association entitled to vote on an amendment to the declaration and that such provision supersedes any contrary requirement in a dedicatory instrument;

WHEREAS, Article XIII, Section 1 of the Declaration provides the Owners of Homes may amend the Declaration with at least sixty-seven percent (67%) of the votes of the Association; F, WHEREAS, as evidenced by the attached certification by the Secretary of the Association, members of the Association representing at least sixty-seven percent (67%) of the total votes allocated to members entitled to vote on an amendment to the Declaration approved this Seventh Amendment to the Declaration for Las Palmas Luxury Townhome Association, Inc. at a meeting of the Association’s membership conducted on 2022.

Indoors/Outdoors. A permitted pet must‘be maintained inside the Home and may. not be kept on patios or balconies unless.accompanied by its owner. No pet is allowed on Common Area unless carried_or. leashed.
