FIRST AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR LIVELY RANCH This First Amendment to Declaration of Covenants, Conditions and Restrictions for Lively Ranch (the “Amendment”) is made by HWY 29 Ventures 2015, L.P., a Delaware limited partnership (the “Declarant”), and is as follows: RECITALS: A. WHEREAS, Lively Ranch subdivision (the “Subdivision”) was established and is governed by that certain Declaration of Covenants. Conditions and Restrictions for Lively Ranch recorded as Document Number 2017109533 in the Official Public Records of Williamson County, Texas (the "Declaration"); B. WHEREAS, Section 2.19 of the Declaration sets forth requirements for owners to erect one outbuilding. Among these restrictions for outbuildings is that the height of the outbuilding, measured from the surface of the Lot or Unit to the highest portion of the outbuilding, must be less than or equal to six feet (6’): C. WHEREAS, Section 2.22 of the Declaration states “Vehicles that are not prohibited by Section 2.20 or Section 2.21 may park on public streets if the city or applicable Governmental Authority allows curbside parking. Parking longer than 48 hours may be controlled by the ACC in its discretion.”; D. WHEREAS, HWY 29 Ventures 2015, L.P., a Delaware limited partnership is the

WHEREAS, Section 12.03 of the Declaration allows the Declarant, acting alone, to amend the Declaration until the end of the Development Period; F. WHEREAS, the Development Period, as defined in the Declaration, has not ended; G. WHEREAS, Declarant wishes to amend Section 2.19 of the Declaration to increase the allowed height of outbuilding from less than or equal to six feet (6°) to less than or equal to seven feet (7°); and H. WHEREAS, Declarant wishes to amend Section 2.22 of the Declaration to modify the restrictions on street parking; NOW, THEREFORE, the Declarant hereby amends Section 2.19 of the Declaration to increase the allowed height of outbuildings, measured from the surface of the Lot or Unit to the highest portion of the outbuilding, to less than or equal to seven feet (7°); THEREFORE FURTHER, the Declarant amends, replaces and restates section 2.22 of the Declaration in its entirety to state as follows: “2.22 On Street Parking. No resident street parking is allowed. Residents shall not park on any portion of the Lot other than the driveway or garage. Resident vehicles must be parked 2 completely in the garage or driveway and no portion of the vehicle may encroach on any portion of the Lot that is not the driveway or garage including, but not limited to, the sidewalk or the lawn.
Residents’ guests are allowed to park on the street for 48 hours. Residents must notify and receive written approval from the Board of Directors for guests to park on the street longer than 48 hours
