WITNESSETH: WHEREAS, the Association is governed by that certain ae Conditions and Restrictions for Mistletoe Hill recorded on Fobrug D204042676 of the Real Property Records of Tarrant Coun following documents, all of which are recorded in the Real P aGaicd 0 avenants, 084_4s/Document # D211132527; (4) that certain Third Supp lene #D211147182; (5) that certain Fourth Supp # D211216520; and (6) that certain Fwd Document # D213029140 (collectively, the WHEREAS, Section lif the Decl4ra}ion provides the New Construction Committee application and review procedures for the Properties; WHEREAS, Sec . e Declaration provides that the NCC and/or Board of Directors (the “Board)-ma ateYally amend the Design Guidelines; and ORE, the NCC and/or the Board hereby amend the Design Guidelines as Section 7(P) of the Design Guidelines is hereby deleted in its entirety and restated P. Outbuildings. No treehouse or children’s playhouse shall be visible from any street or taller than the privacy fence surrounding it without prior written approval of the NCC. Outbuildings or other structures, temporary or permanent, other than the Residence or garage (i) shall be limited to its entirety and restated as follows: {90303714) Page 2 of 3 ten feet (10’) in height, and (ii) shall be-subject to approval by the NCC unless the structure is six feet (6’) or less in height and is not visible from any Association street. Any other type of permitted outbuilding must be in keeping with the overall character and aesthetics of the Residence located on the Lot. The NCC shall require prior approval of all outbuildings, shade structures or pool buildings. Any outbuilding will be required to be constructed with material and of a design that is determined by the NCC to be compatible with the design of the Residence. No permanent outbuilding or play structure will be permitted to be placed on easements or forward of the front building line. Notwithstanding the foregoing in this Section 7(P), sheds and children’s playhouses, permanent or temporary, are permitted to be twelve feet (12’) in height at such structure’s highest point. The NCC is hereby authorized to determine what constitutes a violation of this restriction.
