FIRST SUPPLEMENTAL AND AMENDED RESTATED AND AMENDED DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS THAT COUNTY OF HARRIS § WHEREAS, under date of April 1, 2025, Houston LD, LLC, a Texas limited liability company, recorded that certain Restated and Amended Declaration of Covenants, Conditions and Restrictions for Moore Landing under Clerk’s File No. 2025030853 of the Real Property Records of Montgomery County, Texas (the “Declaration”); capitalized terms not otherwise defined herein shall have the meanings assigned in the Declaration; and WHEREAS, by terms of said Declaration, land subject to the Declaration is placed within the jurisdiction of the Moore Landing Property-Owners Association, Inc. (the "Association"); and ‘ WHEREAS, Article 12, Section 12.04 of the Declaration allows Declarant, without the consent of any Owners or any other Person, the right to amend, modify, revise or repeal the Declaration during the Development Period; and WHEREAS, this Supplemental and Amended Restated and Amended Declaration of Covenants, Conditions, and Restrictions is made within the Development Period.
NOW, TH EREFORE, pursuant to the power reserved in the Declaration, Declarant hereby declares that the real property described in the Declaration, whether originally described therein or annexed thereto, including the improvements constructed or to be constructed thereon, is hereby subjected to the provisions of this Supplemental and Amended Declaration 1. Article 10, Section 10.30 is hereby amended by the addition of the following language as the third grammatical paragraph of Section 10.30, as if originally contained therein:

Article 10, Section 10.30 is hereby amended by the addition of the following language as the third grammatical paragraph of Section 10.30, as if originally contained therein: “Notwithstanding any inconsistent or contrary provision in this Declaration, if there are any FHA, VA, or USDA insured loans affecting a Lot, and only for so long as any such loans affect the Lot, any restrictions in this Declaration on renting, subleasing, or reconveyance that violate any FHA, VA or USDA requirements will not apply to such Lot or its Owner.”
Nothing herein contained is intended or shall be construed to amend the Declaration other than to add the third grammatical paragraph to Section 10.30 of the Declaration.
