2308 604 8783 AMENDMENT TO MASTER DECLARATION OF COVENANTS, CONDITIONS, ASSESSMENTS, CHARGES, SERVITUDES, LIENS, RESERVATIONS AND EASEMENTS THE STATE OF TEXAS COUNTY OF COLLIN THIS AMENDMENT (the "Amendment") TO MASTER DECLARATION OF COVENANTS, CONDITIONS, ASSESSMENTS, CHARGES, SERVITUDES, LIENS, RESERVATIONS AND EASEMENTS (the "Master Declaration") is made and entered into as of the day of February, 1986, by GREAT SOUTHWEST HOMES, INC. ("Declarant").
WITNESSETH: WHEREAS, Declarant did establish a general plan of development upon certain property located in Collin County, Texas by means of the Master Declaration, dated March 20, 1985, and filed for record in Book 2090, Page 858 of the Collin County, Texas Records; and WHEREAS, all capitalized terms used herein shall have the same meaning as provided in the Master Declaration unless expressly provided to the contrary herein; and WHEREAS, pursuant to Section 12.02 of the Master Declaration, the owner of sixty percent (60%) of the total votes entitled to be cast and fifty-one percent (51%) of the First Mortgagee holding liens against such lots shall have the right to amend the Master Declaration; and WHEREAS, Declarant owns sixty-seven percent (67%) of the total votes entitled to be cast and the First Mortgagee holding lien against such lot has consented to the Amendment herein contemplated.
NOW, THEREFORE, Declarant hereby amends the Master Declaration as follows: 1.
Article 1.F is amended by adding a new Item (5) which shall read as follows: 2.
