D POOLS & SPAS WHEREAS, the Saddlecreek Farms Property Owners Association (the "Association") is charged with administering and enforcing those certain covenants, conditions and restrictions contained in the Declaration of Covenants, Conditions and Restrictions for Saddlecreek Farms, Sections I. II and III (the "Declaration"); WHERAS, Section 204.010 of the Texas Property Code authorizes the Association, acting through its board of directors, to regulate the use, maintenance, repair, replacement, modification and appearance of the subdivision, and further authorizes the Association to implement architectural control guidelines; WHEREAS, Section 4.02(c) of the Declaration gives the Architectural Control Committee (ACC) the authority to promulgate minimum construction standards for the construction of Improvements; WHEREAS, to the extent the regulations contained herein conflict with any previously existing rules, regulations or architectural guidelines of the Association, the regulations contained herein control: and NOW, THEREFORE, pursuant to the foregoing, the Association hereby adopts the following: Policy Prohibiting Above-Ground Pools & Spas A swimming pool is expressly defined as an "Improvement" under Section 1.17 of the Declaration.

All swimming pools and spas (or outdoor hot tubs) must be approved in writing by the Architectural Control Committee prior to construction or installation. Above-ground swimming pools, spas or hot tubs are expressly prohibited.
