CHRISTIAN NEW HANOVER COUNTY, NC 2004 JUL 13 02:45:18 PM BK:4405 PG:441-443 FEE:$17.00 INSTRUMENT # 2004036982 STATE OF NORTH CAROLINA COUNTY OF NEW HANOVER SUPPLEMENTAL DECLARATION OF COVENANTS CONDITIONS AND RESTRICTIONS FOR PHASE 2, SECTION 3, SAGEWOOD AT PLANTATION LANDING This Declaration, Made the 12 day of July, 2004, by SSP INVESTMENTS, INC., a North Carolina corporation, hereinafter referred to as "Declarant" or "Developer" for the purposes hereinafter stated; WITNESSETH: Whereas, Declarant has subjected Plantation Landing, Phase 1, shown on map recorded in Map Book 43, Pages 173-175, Phase 1, Section 2, shown on map recorded in Map Book 44, Page 125, and Phase 1, Section 3, shown on map recorded in Map Book 45, Page 58, and Sagewood at Plantation Landing, Phase 2, Section 1 as shown on map recorded in Map Book 45, Pages 58-61 and Phase 2, Section 2, as shown on map recorded in Map Book 45, Page 145, all of the New Hanover County Registry, to a Declaration of Covenants, Conditions and Restrictions (the “Declaration") recorded in Book 3575 at Page 1, New Hanover County Registry; and Whereas, Declarant has added Phase 2, Section 3, Sagewood at Plantation Landing to and made it a part of the Planned Community (as defined in the Declaration), the same being shown on a map thereof recorded in Map Book 46, Pages 140141, in the office of the Register of Deeds of New Hanover County ("Sagewood"); and Whereas, Declarant desires for Phase 2, Section 3, of Sagewood to be subject to the Declaration so that Lot Owners within Sagewood may enjoy all of the Common Elements within the Planned Community (as will the Lot Owners within any other sections that may hereinafter be annexed to the Planned Community).

Now, therefore, Declarant hereby declares that all of the property within Sagewood, as described above, shall be held, sold and conveyed subject to the Declaration, as hereinafter amended, which Declaration, as amended, shall run with the land and be binding on all parties having any right, title or interest in Sagewood, their heirs, successors or assigns, and shall inure to the benefit of each owner of real property within Sagewood.
