About This Village This Handbook is published by the Board of Directors of Second Victorian Village Townhouse Corporation. The purpose of the Handbook is to provide residents with information about the amenities, facilities, and rules and regulations of the community. Each resident should become familiar with the contents of the Handbook and participate in maintaining the quality of life in Second Victorian Village. A copy of the Handbook is filed with the Harris County Clerk's Office. Additional copies of the Residents’ Handbook are available at the Village’s management office and on the website. There may be a nominal fee for a printed duplicate. The Handbook is available on the internet for free.

Second Victorian Village (SVV) is a townhouse community, sited on 18.5 acres located in the 10500 block of Hammerly Boulevard, between Triway Lane and Shadowdale. There are

Second Victorian Village (SVV) is a townhouse community, sited on 18.5 acres located in the 10500 block of Hammerly Boulevard, between Triway Lane and Shadowdale. There are 179 townhouses located in 28 buildings. The majority of townhouses are owner occupied.

The Village has a clubhouse, two large swimming pools, a tennis court, a basketball court, and a playground. The Village is located in the Spring Branch Independent School District. Spring Woods High School, Spring Oaks Middle School, and Westwood Elementary School are conveniently located on Hammerly Blvd. Eastbound and westbound Metro stops ate on Hammerly near the Village; Northbound and Southbound Metro stops are on Gessner near the Hammerly intersection. A Village map is shown in the back of the Handbook.

Second Victorian Village owns, operates, and maintains the common atea, amenities, and facilities. SVV was incorporated under the Texas Non-Profit Corporation Act in August 1968. It also is referred to as the Association. The two terms are interchangeable. All homeownets are members of the Association. , RP-2018-343724 Management of the Village Second Victorian Village is governed by a seven-member Board of Directors clected by the townhouse owners. Two or three new directors are elected annually, each serving a three-year term. Directors serve as volunteers and do not reccive pay. Officers are elected by the Board of Directors at the first meeting following the annual meeting. The duties of the Board of Directors, officers, and committees are detailed in the Bylaws of Second Victorian Village Townhouse Corporation.

Board Meetings—Board Meetings ate held in the clubhouse at 7:00 p.m. on the second Monday of every month unless otherwise announced. Residents are welcome to attend board meetings. An agenda for each meeting is posted on the bulletin boards outside the clubhouse entrance and by the West pool three days preceding each meeting. Residents who wish to address the board must sign up to speak before the meeting begins and will be given an opportunity to address the board during the open forum portion of the meeting. Speakers may ptesent problems, give suggestions, and provide or request information. The board may or may not be able to make an immediate response to a speaker, depending on the nature of the matter.

Annual Meeting of the Corporation—The Bylaws specify that a corporate meeting is to be held annually to elect Directors and to provide a report on the operation and condition of the Village. Annual meetings are held in the clubhouse at 8:00 p.m. on the fourth Monday in January, unless that is a holiday. If the normal meeting date is a holiday, the annual meeting will be held the next day. A written notice of each annual meeting and the agenda ate mailed to Association members (owners) at least 15 days prior to the mecting. Owners may vote by proxy when unable to attend an annual meeting, Proxy forms are mailed with meeting announcements.

Board members and officers are also required to read and understand the governing documents and act in strict accordance with the RP-2018-343724 directives contained therein, without regard to personal views. They must hold the overall . interests of the homeowners of Second Victorian Village above any personal conflicting interest.

References—Throughout this Handbook references are made to the By/aws and The Declaration of Covenants, Conditions, and Restrictions (DCCR) of Second Victorian Village. This Handbook is supplementation and adds definition to the DCCR and Bylaws, rather than over-tiding them. In the event of conflict, the order of hierarchy is DCCRs, Bylaws, and then the Handbook. All ownets of Second Victorian Village are legally bound to abide by the rules and restrictions contained in those documents. Owners are responsible for tenant compliance and should provide them the copies of the Residents’ Handbook. The Bylaws, Covenants and Residents’ Handbook are available at the Village’s management office and on the website.

RP-2018-343724 Financial Obligations Each year an Annual Maintenance Assessment is levied to pay for the operation and maintenance of the Village. This assessment is calculated based on the July Consumer Price Index cach year. Payments are prorated over twelve months and ate due on the first of each month. The maintenance assessment can be paid on an annual basis. Residents are responsible for paying monthly water bills based on metered usage plus a shared portion (1/179) of

Billing, pursuant to TCEQ (Texas Commission of Environmental Quality) procedures, is performed by the Village.

Special Assessments In addition to the Annual Assessment, funds for major capital improvements may be obtained through special assessments. Capital improvement may include, but are not limited to, new roofing, pool resurfacing and decking, sewer lines, fencing, gating, lighting, carports and playgrounds. Such assessments must be approved by a vote of the homeowners in accordance with Section 4 of the Covenants, Conditions and Restrictions and Article XII, Section 5 of the Bylaws.

The Board of Directots sets aside a portion of each annual maintenance assessment to pay for major maintenance projects. These funds are placed into an interest-bearing reserve fund. The reserve fund helps to minimize the need for special assessments.

RP-2018-343724 Committees Committees provide advice and oversight and may assist on various tasks at Second Victorian Village. Committees are formed by the Board of Directors. All members are encouraged to patticipate in the activities of one or more committees. Homeowners can join a committee by contacting the committee chairperson or the president of the board or through the management company or website.

The Architectural Control and Nominating Committees are required by Article IX of the Bylaws. Other committees may be created by the Board of Directors to serve special needs.

Each committee elects a chairperson who teports committee recommendations to the board at the regular monthly board meeting. It is recommended that each committee set a regular meeting date and the Chair give notice by distributing an agenda to all committee members three business days in advance. Meetings should be held in the clubhouse.

Committees Dictated by Bylaws 1. Architectural Control—The Architectural Control Committee reviews, approves or disapproves applications for additions or alterations to townhouse and patio exteriors. See Article VIII of the Covenants as well as Section 7.3 of this Handbook.

2. Nominating/Elections—The Nominating Committee identifies and nominates candidates for election to the Board and assists the secretary of the Board in conducting the annual election.

Optional Committees as Determined by the Board of Directors 1. Audit—The Audit Committee meets in the Fall and supervises the annual audit of the Association's books, approves the annual budget and the statement of income and expense to be presented to the membership at its annual meeting. The treasurer is an ex-officio member of the committee.

2. Bylaws—The Committee studies and recommends modifications or additions to the Bylaws.

3. Landscape and Gardens—Assists the board with landscape, maintenance and beautification planning for SVV common ateas.

5. Special Assessment—A special assessment covers costs not covered by the regular monthly maintenance assessment. The Special Assessment Committee researches the need for specified projects. They reseatch and analyze the information and make a presentation to the board. If the board approves the project, then the committee also hosts ways of communicating this information to the homeowners, making sure they are completely informed prior to voting on a special assessment.

RP-2018-343724 Community Events and Newsletter Community Events Planned community events are encouraged and may be of vatious themes. Watch for the announcements of special events in the Village Voice, through the website and on the community bulletin boards. Please share ideas with a board member.

Residents are encouraged to suggest programs that would be of interest to them, to participate in the presentations, or just to enjoy visiting with other residents.

Village Voice The Village Voice is a newsletter published monthly by the Communications Committee. Its purpose is to inform the Village of issues being addressed by the board and activities occurring within the Village community. The newsletter is distributed and placed on townhouse back gates, as well as uploaded to the community website. It is also sent, upon request, via email.

Anyone wishing to help prepare the publication or to present a newsworthy item should contact the editor listed in the current edition of the Village Voice.

RP-2018-343724 Community Facilities Facilities and Grounds The Community Facilities and Grounds described below are for the enjoyment of all residents and guests, subject to the rules as published in this Handbook.

Privileges—The board has the authority to suspend the privileges of residents who refuse to comply with the rules, or who are not current in paying fees.

Resident Tags—Resident Tags are for the putpose of distinguishing residents from nonresidents, When using the basketball court, tennis court, or swimming pool, the Village requires that the resident/tenant keep the Resident’s Tag in a visible location. The Courtesy Patrol can spot check that usets are indeed residents. Residents are responsible for any guests and their behavior. (Guests do not require a tag.) We appreciate homeowner cooperation regarding this.

If the homeowner/tenant does not have their Resident’s Tag with them when using the basketball court, tennis court, or swimming pool, the Courtesy Patrol may ask that resident to leave. Repeated violations may result in the tag/key being confiscated. If this happens, the homeowner/tenant must appear before the board at its regularly scheduled meeting to resolve the matter. Meanwhile the homeowner/tenant may not use the facilities.

Obtaining a Resident’s Tag—Residents ate asked to please register their family with the management company (see contact information on the bulletin board posted by the office door) to receive their Resident’s Tag. Residents will be asked to complete a form identifying all members of their household and their ages. The first Resident’s Tag issued per household will

Key—The swimming pool and tennis court key may be obtained through the management company during regular office hours. The key belongs to the Association and cannot be duplicated. A $25 refundable deposit is required payable by check only.

Swimming Pools 1. Pools—There ate two pools at Second Victorian Village. The East pool is at the Clubhouse; the West pool is on the West side of Drive L.

Pool Hours—Pool hours are dawn to 10:00 P.M.

Supervision Requited—At all times all children under the age of 15 years must be accompanied by an adult age 18 or over.

Swim at Your Own Risk—There is no lifeguard at either pool. All swimmers swim at their own risk. It is recommended that no one swim alone. At least one other person should be present. By making use of the pool facilities, the user is agreeing to abide by all pool rules and to hold the Association harmless for any accidents ot injury as a result of user’s use of the facilities.

Guests—Residents may have up to five guests per household accompany them and the resident must remain with their guests at all times. No more than a group of six people per resident is permitted at any time. Residents are responsible for their guests and their guests’

By inviting a guest to use Association facilities, residents are agreeing to indemnify the Association from any damage as a result of said guests’ use of SVV facilities.

No Private Parties—No private parties in pools or pool areas ate permitted. Pools may not be rented for a private party.

Pool Keys—Per city code, pool gates must be kept locked at all times. One key will be issued to each townhouse for a refundable deposit of $25. Loss of the assigned key will result in a $25 replacement fee.

Resttoom—Restrooms ate located at both pools. Adults are requested to assist small children when they use the restrooms so that the facilities are kept clean.

A description of the proposed changes and sketches illustrating the nature, location, configuration, dimensions, materials, and type of finish, with color samples, is required.

An architectural request must be approved before construction is started or before a change is made. An ACC request fotm may be found on the website or through the management company.

If new construction or exterior changes are made without the approval of the Board of Directors, owners may be requited to remove the new construction or to restore the townhouse to its original condition at the owner's expense.

Only one FOR RENT or FOR SALE sign may be displayed in top rear window. Such signs may be no larger than 5 square feet, and may only be placed at the rear of a townhouse.

Construction of storage racks or sheds in carports is not permitted.

Exterior radio and television antennas must not be attached to the roof or the sides of the building. The homeowner must have architectural control approval before installation.

Clotheslines must be confined to patios and must not be visible from the driveway.

Hanging clothes, towels, rugs, and other items over balcony railings, patio fences, and carports is not permitted.

Trash bin doors must be closed and secured at all times.

Trash and garbage must be placed in plastic bags for regularly scheduled pickup. Vines are not allowed to grow on downspouts, siding, or wood, but they may grow on brick. Trees must be cut back so they do not touch roofs, siding, or brick. Trees too close to the foundation or trees that ate large enough to fall on the building are not permitted in patio areas and must be removed at the expense of the homeowner. Any damage caused by a tree to a neighboring property will be paid for by the non-compliant homeowner, i.e. root damage to patios, fencing, brick walls, carports, garden sheds, roof or other structural damage to the building.

Residents who obtain authorization to construct patio covers and lattice work above their patio fences ate required to keep them properly maintained. Wood must be painted or stained earth tone colors to complement the color scheme of the townhouse. If the patio cover is not maintained, the necessaty maintenance will be performed by the Association and billed to the owner.

Termites and Other Pests 1) The Association has a contract for annual subterranean termite treatments around the exterior of all townhouses. The Village office or management company will provide notification as to when the inspection will occur. Residents are requested to make their property accessible to the inspector.

Extermination services for all other pests inside or outside individual townhouses and in patio areas are the responsibility of townhouse owners.

General Liability—Protects all members of the Association (all townhouse owners) against claims and lawsuits which might result from someone being injured on the common area property. This coverage also protects against damage or injury caused by our employees in the coutse of performing their maintenance duties.

Workers Compensation—Protects the Association against claims by an employee who is injured during the performance of his or her duties.

Property—Protects the Association, owners, and mortgage lenders against physical damage to townhouses. This coverage is discussed in more detail below.

Directors and Officers Liability—Protects volunteers who setve as Directors and Officers of the Association against lawsuits.

Fidelity Bond—Protects the Association against monetary loss caused by dishonest acts of the directors, officers, or employees.

How Insurance Premiums Are Paid Ve Premiums for the above insurance coverages are paid annually by all members of the Association (all townhouse owners). Statements and certificates of insurance are sent out annually by the Village insurance agent. For those whose insurance premiums are included with their mortgage payments, the statements and certificates are sent to the homeownet’s mottgage company with a copy to the owner. Questions concerning premium payments should be addressed to the Village insurance agent. Contact the management company for information.

3. Owners who rent their townhouse should obtain coverage for liability as a landlord. The Association’s policy does not provide such coverage. 23 RP-2018-343724 13. Parking Rules General Parking Rules uM Parking is not permitted in areas which are painted with a red stripe. ‘These are “Tow Away Zones,” or “Fire Lanes.” Parking is not allowed on either side of the gates on Shadowdale as they ate for Fire Department emergency access.

The following parking areas are for the use of all residents and their guests: a. The strip against and along the North property fence.

Double parking is defined as a parked vehicle that blocks drive access, in or out, of an ownet’s parking area designated for their townhouse, safety areas as marked, or any common area used for public parking.

All vehicles parked in the Village are subject to the Texas Transportation Code’s definition of a Junked Vehicle (Section 621.001, Section 9).

Carports and spaces between carports are to be kept free and clear of personal items including but not limited to pots, chains, lawn chaits, grills, etc., so as not to inhibit parking ot access to the trash bin area. Carports and spaces between carports are to be used for parking motorized vehicles only.

Rules for Trailers, Recreational Vehicles, and Boats Trailers, recreational vehicles (RVs), and boats may be parked on the property for petiods not to exceed 5 days along the North Fence only. All trailers, RVs, and boats must be currently registered and licensed.

2. Moving trucks may patk along the North fence overnight if necessary. Please notify the management company if this is needed.

3. Moving trucks may not be driven onto lawns or walks. Perpetrators are liable for damages.

Major repair work on vehicles, including overhauls, brake repairs, rotation of wheels, major bodywork and other repairs on vehicles ate not permitted in the Village. Townhouse Living Mutual Enjoyment Residents are entitled to the use and enjoyment of the common area and facilities of Second Victorian Village and are encouraged to assist each other in creating a pleasant environment for all to enjoy. Please be considerate of neighbors when entertaining.

Garage Sales Garage sales are permitted and may be held by owners or residents no more than four times per

No owner shall use or permit such owner’s residence to be used for any purpose that would (i) void any insurance in force with respect to the subdivision; (ii) make it impossible to obtain any insurance required by these restrictions; (iii) constitute a public or private nuisance, which determination may be made by the board at its discretion; (iv) constitute a violation of the restrictions, any applicable law, ordinance, rule or regulation; or (v) violate any ordinance of Harris County, Texas.

Definition: “Operation of a Business” is defined as any activity, whether for profit or not, that permits increased vehicular, or pedestrian traffic on the property. This would include, but not be limited to, activities which require employees, clients, delivery, courier, Federal Express, United Parcel Services, the United States Postal Services, or the like, to regularly come onto the property. Definition of a Home Office: Home office activities may include volunteer work, hobbies, office work from a regular job, or a professional who may work at home.

Create noise, vibration, glare, fumes, odors, or electrical or electronic interference detectable by neighbors.

Display signs indicating that the townhouse is being used other than a residence.

Generate excessive traffic (foot or vehicular, or parking usage by clients, customers, delivery services or others).

Have equipment or other items related to the business stored, parked, or otherwise kept outside the townhouse or in any common area.

Have employees on-site, other than members of the family, who also reside in the townhouse.

Involve the use, storage, or disposal of any materials classified as hazardous under federal, state or local law.

Function primarily as a business. The business should be subordinate to the use of the
