Box 32000, Raleigh, NC 27622 NORTH CAROLINA DURHAM COUNTY BOOK1144 PAGE 95 DECLARATION OF RELEASE AND ABANDONMENT OF EASEMENT For and in consideration of the sum of ONE AND NO/100 ($1.00) in hand paid, the receipt of which is hereby acknowledged, SOUTHERN BELL- TELEPHONE AND TELEGRAPH COMPANY, a Georgia corporation, does hereby declare that, only to the extent more particularly described below, it is abandoning, quitclaiming and releasing to the previously affected landowners all of its right, title and interest in and to that certain right-of-way easement dated February 25, 1928, from J. M. Proctor and wife Lula B. Proctor to American Telephone and Telegraph Company recorded in Deed Book 93 at page 34, Durham County Registry, and assigned to Declarant by instrument recorded in Deed Book 434 at Page 145, • Durham County Registry.

The portion of the said easement so abandoned, released and quitclaimed is described as follows: BEING all of that 100 foot wide telephone line easement shown on a plat of the PROPERTY OF H. E. BEANE AND WIFE INEZ BEANE as recorded in Plat Book 14 at Page 15 in the Office of the Register of Deeds of Durham County which runs from the southernmost property line as shown on said plat to the eastern right-of-way line of Guess Road.

It is expressly understood and agreed that this instrument shall in no way affect the validity of a new easement previously granted to Declarant for a strip 10 feet by 100 feet on the eastern side of Guess Road and recorded in Real Estate Book 933 at page 55, Durham County Registry.

IN WITNESS WHEREOF, SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY has caused this Declaration of Release and Abandonment of Easement to be signed in its corporate name by its duly authorized officers and its seal to be hereunto affixed by authority of the Board of Directors.
