73 WD FIRST SUPPLEMENT AND ANNEXATION TO THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR STONE CREEK ADDITION PHASE II STATE OF TEXAS COUNTY OF TARRANT KNOW ALL MEN BY THESE PRESENTS: THIS FIRST SUPPLEMENT AND ANNEXATION TO THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR STONE CREEK ADDITION PHASE II (this "First Supplement") is made this 22nd day of May, 2003, by and among STONE CREEK ADDITION HOMEOWNERS ASSOCIATION, INC., Pexas non-profit corporation (the "Association"), and the owners of lots located in Stone Creek Addition Phase I, as shown on Exhibit "B" attached hereto and incorporated herein for all purposes (the "Owners").
Unofficial Copy WHEREAS, FW-SC, Ltd. a Texas limited partnership, as Declarant, recorded that certain Declaration of Covenants, Conditions and Restrictions for Stone Creek Phase I, dated May 8, 1998, and recorded as Instrument No D198 M3410 of the Real Property Records of Tarrant County, Texas (the "Phase I Declaration"); and WHEREAS AW-SC Phase II Partners, Ltd., a Texas limited partnership, as Declarant, recorded that certain Declaration of Covenants, Conditions and Restrictions for Stone Creek Phase II, dated August 19, 1999, and recorded as Instrument No. D198113410 of the Real Property Records of Tarrant County, Texas (the "Phase II Declaration"); and OWNER CONSENT TO FIRST AMENDMENT TO THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR STONE CREEK PHASE II - Page 1 WHEREAS, the Phase I Declaration did not provide for the creation of a homeowners association to maintain, administer and enforce the covenants forth therein; and WHEREAS, the Phase II Declaration created the Association as a Texas non-profit corporation to administer, maintain and enforce the covenants set forth therein; and
ce the covenants forth therein; and WHEREAS, the Phase II Declaration created the Association as a Texas non-profit corporation to administer, maintain and enforce the covenants set forth therein; and WHEREAS, Article IX, Section 9.2 of the Phase II Declaration provides that the Association may annex additional property not subject to the Phase II Declaration by cbtaining the approval, in writing, of at least two-thirds (2/3) of the outstanding votes of the members of the Association and by a declaration of annexation executed by the owners of the property to be annexed; and WHEREAS, as evidenced by the signatures of at least two-thirds (2/3) of the members of the Association as set out in Exhibit “A” and signatures by the Owners of certain lots located in Phase I, which lots are described and set out in Exhibit Band incorporated herein, the Owners of Unofficial Copy the lots described in Exhibit "B" desire to annex their lots into the Phase II Association and subject their lots to all the terms, covenants, conditions and restrictions of the Phase II Declaration.
NOW, THEREFORE, the Phase II Declaration is hereby amended to annex into the Association the lots located in Stone Creek Addition Phase I as more particularly set out in Exhibit "B" attached hereto and incorporated herein and the lots described in Exhibit "B" are hereby expressly subjected to all the terms, covenants, conditions and restrictions of the Phase II Declaration. The lots described in Exhibit "B" and the owners thereof are hereby a part of and members of the Stone Creek Addition Homeowners Association, Inc.
Except as modified by this First Supplement, the Phase II Declaration shall remain in full force and effect.
