Box 376, Durham, NC 27702 NORTH CAROLINA PROTECTIVE COVENANTS DURHAM COUNTY SURREY GREEN II THIS DECLARATION, made this 3rd day of March, 1993 by SOUTHLAND ASSOCIATES, INC., a North Carolina corporation with its principal office and place of business in Durham, Durham County, North Carolina (hereinafter referred to as “Southland”).

WITNESSETH: Southland hereby declares that the following described real proporty located in Durham-Out Township, Durham County, North Carolina, to wit: Being all of lots 1, 2, 3, 4 and 5 of Block A and all of lots 1, 2, 3, 4 and 5 of Block B as described in plat and survey by Triangle Surveyors, Inc. dated February 3, 1988, entitled "Surrey Green 11”, (Owner/Developer Southland Associates, Inc.), recorded in the Office of the Register of Deeds of Durham County in Plat Book 117 at Page 68, to which reference ia hereby made for a more particular description, is and shall hereafter be held, transferred, sold and conveyed, subject to the following protective covenants and restrictions, to wit: 1. The hereinabove cescribed lots shall be used for single family, | residential purposes only and no buildings other than a single residence, except garages or outbuildings for domestic purpcses, shall be built on any hereinabove described lot. In consideration of the dedication and recordation of these protective covenants, the hereinabove described lots shall become and shall hereafter be single family, residential lots for the purpose of assessments and payment of dues to Surrey Green Homeowners Association, Inc.

2. These protective covenants shall be in addition to and not in lieu

be single family, residential lots for the purpose of assessments and payment of dues to Surrey Green Homeowners Association, Inc.

These protective covenants shall be in addition to and not in lieu of those protective covenants previously recorded in the Office of dH the Register of Deeds of Durham County in Book 1041 at Pages 585-590 inclusive and Book 1472 at Pages 638-641 inclusive, which said protective covenants are incorporated herein by reference and made a part hereof as fully and completely as if set forth herein verbatin, BOK 1S 34 pace 579 4. Enforcement shall be by proceedings at law or in equity against any .

Person or persons violating or attempting to violate any covenant, @ either to restrain violation or to recover damages, or both.

5. These protective covenants shall run with the lota and other real property of Surrey Green II, and every part thereof by whomsoever owned; and invalidation of any one of these covenants by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect.
