Grantees: Nicole Wray, Steven Wray, Michelle Durner, Daniel Johnson STATE OF NORTH CAROLINA SUPPLEMENTAL DECLARATION FOR THE LANDING AT SOUTHPOINT CONDOMINIUM REALLOCATING GARAGE SPACE COUNTY OF DURHAM THIS SUPPLEMENTAL DECLARATION FOR THE LANDING AT SOUTHPOINT CONDOMINIUM REALLOCATING GARAGE SPACE is made as of this 20th day of May, 2016, by The Landing at Southpoint Condominium Association, Inc., a North Carolina nonprofit corporation (“Association”); Rosina Orr as the owner of Unit 2305 (“Orr”); and Nicole Wray, Steven Wray, Michelle Durner, and Daniel Johnson as the owners of Unit 2104 (collectively, “Unit 2104 Owners”).

WITNESSETH: WHEREAS, LSP Development, LLC, a North Carolina limited liability company, caused to be recorded a Declaration for The Landing at Southpoint Condominium Pursuant to Chapter 47C of the North Carolina General Statutes, the North Carolina Condominium Act, in Book 6122, Page 168 in the Durham County Registry, which was thereafter amended and supplemented (collectively, as amended and supplemented, “Declaration’’); WHEREAS, the Declaration was specifically amended in Book 7922, Page | of the Durham County Registry, which amendment renumbered and reallocated garage parking spaces among certain units (the “Garage Amendment”); WHEREAS, there are fifteen (15) garage parking spaces (“Garage Parking Spaces”)

Registry, which amendment renumbered and reallocated garage parking spaces among certain units (the “Garage Amendment”); WHEREAS, there are fifteen (15) garage parking spaces (“Garage Parking Spaces”) that are reserved for the exclusive use of designated Unit Owners in the Condominium; Book7955 - Page71 Page 2 of 9 WHEREAS, Garage Parking Space 13 was allocated to Unit 2305, which said Unit is owned by Orr; WHEREAS, Article 12.06 provides that a Garage Parking Space allocated to a particular Unit may be transferred to another Unit; WHEREAS, Orr desires that the Garage Parking Space allocated to Unit 2305 be reallocated to Unit 2104, and the Unit 2104 Owners desire the same; WHEREAS, Article 12.06 provides that if a Garage Parking Space is transferred to another Unit, the Association shall prepare and record a supplement to the Declaration recording the same; and WHEREAS, the Association and Orr and the Unit 2104 Owners have agreed to execute and record this Supplemental Declaration for the purpose of reallocating the Garage Parking Space 13; NOW THEREFORE, for good and valuable consideration in hand paid, the receipt of which is hereby acknowledged, the Association and Orr and the Unit 2104 Owners hereby agree and state: 1. Exhibit D to the Garage Amendment is deleted in its entirety and inserted in lieu thereof is an Amended Exhibit D which is attached hereto and incorporated herein by reference.

2. The Garage Parking Space designated as Garage 13 is hereby allocated to Unit 2104.

Except as amended hereinabove, the remaining portions of the Declaration, including the Garage Amendment, and Exhibits thereto shall remain unchanged and in full effect.
