047, Page 694, RETURN TO: Alan Solana as amended by the Fifth Amendment to Declaration of Condominium For Trolley Path Condominium recorded in Book 4088, Page 840, as amended by the Sixth Amendment to Declaration of Condominium For Trolley Path Condominium recorded in Book 4519, page 414, in the Office of the Register of Deeds of New Hanover County, North Carolina (the "Declaration"); and, WHEREAS, pursuant to Section 47-2-105(a)(8) of the Act and pursuant to the reservation of Development Rights under Article 6 of the Act, Successor Declarant has the right and power to amend the Declaration to add Units, Common Elements and Limited Common Elements to Condominium.

NOW, THEREFORE, pursuant to Section 47C-2-105(a)(8) and ARTICLE 6 of the Declaration, the Successor Declarant does hereby amend the Declaration and does hereby declare as follows: ARTICLE 1 Exhibit A attached to the Declaration as recorded in Book 2459, Page 239 as amended in Book 2596, Page 193 and in Book 2620, Page 583 and in Book 2786, Page 719, and in Book 4047, Page 694 and in Book 4088, Page 840, and in Book 4519, Page 414, in the Office of the Register of Deeds of New Hanover County, North Carolina (the “Registry") is hereby declared null and void and Exhibit A (revised) attached hereto is substituted therefore, adding one (1) building which is Building 4. Building 4 contains eight (8) Units numbered 116, 117, 118, 119, 216, 217, 218 and 219, together with their appurtenant and Limited Common Elements as shown on the Plats and Plans, and interests shown on Condominium Book 14, Pages 51-52 of the Registry. Units 116, 117, 118 and 119 are each first floor units. Units 216, 217, 218 and 219 are each second floor units. Each Unit will be designated by its

n Condominium Book 14, Pages 51-52 of the Registry. Units 116, 117, 118 and 119 are each first floor units. Units 216, 217, 218 and 219 are each second floor units. Each Unit will be designated by its respective number followed by the Building number in which it is located. An example of the designation of a Unit is as follows: “Unit No. 116, Building 4, of Trolley Path Condominium”.

ARTICLE 2 Exhibit B attached to the Declaration as recorded in Book 2459, Page 239 and amended in Book 2596, Page 193 and Book 2620, Page 583 and Book 2786, Page 719, and Book 4047, Page 694, and in Book 4088, Page 840, and Book 4519, Page 414, in the Registry is hereby declared to be null and void and Exhibit B (Revised) attached hereto is substituted therefore, revising the percentage share of the Common Elements and the percentage share of the Common Expenses appurtenant to all Units to the percentages set fourth therein.

ARTICLE 3 There are typical floor plans which are designated and described as follows: (a) (b) (c) (d) A First Floor Unit (“FFU”) contains two (2) bedrooms, two (2) baths, kitchen, living area and dining area. Each FFU has appurtenant to it as a Limited Common Element a front porch and a rear porch.

A Second Floor Unit ("SFU”) contains two (2) bedrooms, two (2) baths, kitchen, living area and dining area. Each SFU has appurtenant to it as a Limited Common Element an entrance, front porch and a rear porch.

A FFU in Building 4 contains approximately 1,114 square feet of enclosed heating area.

ARTICLE 4 Additional Plats and Plans recorded in Condominium Book 51-52 14 Pages entitled Phase 9, Building 4, Trolley Path Condominium, are hereby incorporated as part of the Plats and Plans of the Condominium. Limited Common Elements depicted on the Plats and Plans are hereby assigned as appurtenant to the Units indicated. Those Limited Common Elements described in ARTICLE 3 of the Declaration and not otherwise " depicted on the Plats and Plans are hereby assigned to their appurtenant Units as applicable.

ARTICLE 5 Additional certification pursuant to Section 47C-2-109(d) is attached to the additional Plats and Plans and is hereby incorporated as part of the Plats and Plans of the Condominium.

Except as specifically amended or modified by this Amendment all of the terms, covenants, conditions and provisions of the Declaration shall be and remain in full force and effect and shall apply to the Condominium Units and Limited Common Elements created hereby.
