SUPPLEMENTAL DECLARATION TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS — FOR SILVERADO HILLS This Supplemental Declaration to Declaration of Covenants, Conditions and Restrictions for Silverado Hills (this "Annexation") is made on the date hereinafter set forth by Centex Homes, a Nevada general partnership (the "Declarant").
RECITALS A. Declarant executed that certain Declaration of Covenants, Conditions, and Restrictions for Silverado Hills, recorded as Instrument Number 20070046159, in Volume 12715, Page 1057 in the Official Public Records of Bexar County, Texas, as amended (as amended, the "Declaration").
B. Pursuant to Section 10.1 of the Declaration, Declarant has the right to annex certain additional real property that is located within 1 mile from the Property into Bexar County Silverado Hills Homeowners Association, Inc. (ithe "Association") and subject such property to the terms of the Deciaration.
C. Declarant now desires to annex the real property described in Exhibit "1" attached hereto (the "Annexed Property") into the Association and to subject the Annexed Property to the terms and conditions of the Declaration.
D. The Annexed Property is eligible for annexation pursuant to the Declaration.
E. Declarant desires to further amend the Declaration as provided herein.
ANNEXATION AND AMENDMENT 1. Annexation. The Declarant hereby annexes the Annexed Property into the Association and subjects the Annexed Property to the Declaration, including, without limitation, all of the rights, privileges, duties, and liabilities of the Deciaration.

Notwithstanding anything to the contrary contained in the | Declaration, (i) the Property, or portions thereof (including the Annexed Property annexed pursuant to this Annexation) (a) is not currently located within the City limits of the City of San Antonio, and (b) is currently located within the extraterritorial jurisdiction of the City of San Antonio; and (ii) Silverado Hills Unit - 2 & 4 and Silverado Hills Unit 8 are each an addition to Bexar County, Texas.
4, Notice of Potential Annexation. On the date of this Annexation, the Property, or portions thereof (including the Annexed Property annexed pursuant to this Annexation) is within the extraterritorial jurisdiction of the City of San Antonio and may now or later be subject to annexation by the City of San Antonio. Each municipality maintains a map that depicts its boundaries and extraterritorial | jurisdiction. This paragraph will automatically cease to apply to any part of the Property {including the Annexed 1 Annexation - Silverado Hills Unit - 2 & 4, and Unit 8 Property annexed pursuant to this Annexation) that is annexed by a municipality, without the necessity of amending the Declaration.
5. Full Force and Effect. Except as specifically amended herein, the Declaration shall remain and continue in full force and effect.
6. Defined Terms. Unless otherwise indicated herein, all initial-capped terms used herein shall have the same meanings as ascribed to them in the Declaration.
