WATER RIDGE PROPERTY OWNER'S ASSOCIATION BOARD RESOLUTION GRANTING SPECIFIED VARIANCES FOR EXISTING NON-CONFORMITIES WHEREAS, upon Water Ridge Board of Director (WR BOD) acceptance of control of the Water Ridge Property Owner's Association (WR POA) from the Developer on 23 July 2019, several existing homes within the development exhibited construction-related non-conformities per the current versions of the applicable Covenants, Conditions and Restrictions (CC&Rs) that were in existence on said date; WHEREAS, the BOD received no written documentation from the Developer granting such non­ conformities, and by owner testimony, several of the non-conformities were granted either verbally as part· of the purchase agreement or through 'effective approval' by inaction on the part of the Developer after requests for such variances were received, the BOD is unable to verify the validity for existence of such non-conformities; WHEREAS, on 14 September 2019, at an Open Meeting of the WR BOD, a motion was made and passed to not pursue remediation of construction standard infractions and violations incurred prior to July 23, 2019. Further, at the same meeting, a motion was made and passed to catalog identified infractions for the purpose of recording all such instances of non-compliance and granting variances for same retroactively; WHEREAS, said inventory of participating owners revealed the following construction non­ conformities: 1) Art III, Sec 3-boat dock in place; 2) Art III, 1) Art III, Sec I-detached garage; 2) Art III, III, Sec 6-detached garage within 25' oj front lot line; 5) Art III, Sec 22-two satellite

BE IT ALSO RESOLVED, that all non-conformities noted herein are hereby and henceforth accepted and granted a valid variance as if they had been previously approved by the Architectural Control Committee (ACC) for the WR POA.

BE IT ALSO RESOLVED, that such an inspection for, and acceptance of, CC&R non­ conformities as effected by the WR BOD via motion and passage of such action on 9 September 2019, as recorded in the applicable meeting minutes, is a singular, one-time-only event to aid the new BOD and property owners with existing structures in-moving forward from the deficient variance approval process that existed before 23 July 2019 and the subsequent potential legal difficulties that would be attendant in attempting to coerce compliance with current CC&Rs.

BE IT FURTHER RESOLVED, except for WR BOD or ACC approved variances, that all future construction in the developmemt will be required to comply with all CC&Rs in existence at the time of application to the ACC for project approval. NO NEW OR REMODEL/REBUILD CONSTRUCTION WILL BE APPROVED WITH NON-CONFORMITIES USING THIS RESOLUTION, ANY NON-CONFORMITIES ACCEPTED BY THIS RESOLUTION, OR BY USING NON-CONFORMITIES NOT CATALOGUED IN THIS RESOLUTION, AS PRECEDENT FOR DEMANDING ANY VARIANCES THAT MAY BE AVAILABLE.
