PREAMBLE A Declaration of Covenants, Conditions and Restrictions ("Declaration") has been established for The Manors, by instrument recorded under Instrument No. 99109 of the Real Property Records of Walker County, Texas. Section 2.03 of the Declaration provides, in part, that the Declarant, Frey, Inc., may add to the scheme of the Declaration any property it owns by filing a record of Supplemental Declaration. Said Section 2.03 further provides that the Supplemental Declaration may contain additions, deletions, and modifications from those

any property it owns by filing a record of Supplemental Declaration. Said Section 2.03 further provides that the Supplemental Declaration may contain additions, deletions, and modifications from those contained in the original Declaration to reflect the different character, if any, of the added properties.

This Supplement hereby modifies the Declaration previously filed under Instrument No.

99109 of the Real Property Records of Walker County, Texas in the following Sections.

MODIFICATIONS The following Sections of the Declaration are hereby modified to read as follows with respect to The Manors: (1) Section 4.09 Transfer Fee 2025 - 107894 05/08/2025 04:03 PM Page 3 of 4 1. All initial sales of homesites from the Declarant to a builder or individual is a flat transfer fee of $500.00. All home sales, excluding spec home sales per the exclusions in Section 4.09.2, are a 0.5% transfer fee split ½ and ½ between the Buyer and Seller.

(2) Section 4.18 Marketing Fee 1. Exclusions: a. The marketing fee does not apply to the Builders and/or properties provided to the POA in writing. The Declarant reserves the right to re-instate marketing fees for any Builder they previously exempted from the marketing fee at any time for any reason. The marketing fee is subject to all contractual obligations of each lot sale.
