Canyon Trails is a single-family residential subdivision in Homer, AK. The Canyon Trails Homeowners Association enforces the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that apply to all lots (except Tract A) in the subdivision. These rules govern what you can build, how you can use your property, and the obligations of lot owners.
- Residential use & home businesses: Lots are for single-family residential use only. One mother-in-law living space or a single duplex is allowed if it looks like a single-family home. A separate guest cabin (max 1,000 sq ft) is also permitted. Bed and breakfasts (up to 3 room rentals per lot) and home occupations are allowed if the owner lives on-site and signage is limited to 6 sq ft. No other commercial activity is permitted.
- Architectural review & construction standards: Before any construction, plans must be submitted to the declarant or managing agent for written approval of placement and design; if not approved or disapproved within 30 days, the covenant is deemed satisfied. Exterior construction must be completed within 1 year. Maximum building height is 35 feet from lowest ground level to top. Preferred siding materials are wood, brick, or stone; T1-11, plywood, metal, and vinyl are not allowed unless specifically approved.
- Natural environment & landscaping: Natural vegetation must remain undisturbed except as needed for improvements. Disturbed areas must be replanted with grass, shrubs, or trees within 2 years of starting construction. No vegetation or structure may obstruct a view from another lot; if a neighbor requests trimming, the requesting neighbor pays for a professional tree service, and the declarant/managing agent resolves disputes.
- Vehicles, parking & storage: Recreational vehicles may not be parked on shared driveway easements. They may be parked during customary use season and stored off-season if not unsightly. RVs may be used for living by visiting family from May 15 to September 15 only. Parking on roads or shared driveways is limited to occasional gatherings. No unlicensed off-road vehicles allowed except for ingress/egress. No conex or similar mobile storage units are permitted.
- Animals & pets: Livestock and horses are prohibited. Up to 3 dogs, 2 cats, and a combined total of 10 rabbits, poultry, and fowl are allowed. Roosters and other loud animals (e.g., male peacocks) are prohibited. Animals must be removed if they become a nuisance due to noise, smell, trespass, or similar issues.
- Homeowners Association & assessments: Every lot owner is a member of the Canyon Trails Homeowners Association, with one vote per lot. A 51% majority of all eligible votes is needed to pass issues. The developer acts as managing agent until 75% of lots are sold, then the association may organize. Annual assessments are $75 per lot for landscaping and trail maintenance; this amount cannot be raised without a majority vote of homeowners.
