What Cliff Rose's governing documents say
Cliff Rose is a planned area development (single-family home subdivision with some townhouse/patio home lots) in Prescott, Arizona. The rules in this governing document apply to all lot owners and govern what you can build, how you maintain your property, and your obligations to the homeowners association. This is a full set of covenants, conditions, and restrictions (CC&Rs) as amended several times.
- Architectural review: No building, fence, wall, or other structure may be erected or altered until plans are approved in writing by the Board or an architectural committee. Approval is deemed given if not decided within 30 days of submission. The committee ensures harmony of external design with surrounding structures.
- Building & lot use restrictions: Only one single-family dwelling per lot, with a minimum of 1,200 square feet of living space (amended from original 800). Townhouse units must have at least 640 square feet. No house trailers, mobile homes, dome homes, or moved structures are allowed. Construction must be completed within one year. Maximum two stories. Setbacks: front yard minimum 10 feet (with topographic exception), rear yard minimum 10 feet, side yards with zero-lot-line provisions.
- Pets: Only usual household pets are allowed; no livestock and no breeding of pets for sale. Dogs must be kept leashed on sidewalks, streets, or common areas. Owners must immediately pick up and dispose of animal feces on any property, including unsold lots.
- Assessments & fees: Each lot owner must pay annual assessments to the association. The initial maximum annual assessment was set at $50 (per first amendment). After the first year, the board may increase or decrease the assessment based on percentage of lot ownership and changes in costs for liability insurance, taxes, and common area expenses. Unpaid assessments accrue 12% annual interest and become a lien on the property.
- Common area & property rights: Common areas are to remain in their natural state for the use of all owners. Owners have a non-exclusive easement to use common areas. The association may charge reasonable annual dues to maintain liability insurance, pay taxes, and maintain improvements. Common areas may be dedicated to public agencies with approval of two-thirds of members.
- Maintenance obligations: Each lot owner is responsible for all maintenance, inside and out, of their own lot and improvements. Owners also pay for water, sewer, and garbage collection. No rubbish or unsightly storage is allowed. Unlicensed or unused vehicles may not be stored on lots.
- Parking & vehicles: Each single-family dwelling must have at least a one-car carport or garage and provide at least two off-street parking spaces per lot. Townhouse/patio home units need at least one additional off-street space. No parking on unpaved portions of the lot.
