What Fairway Estates Homeowners Association's governing documents say
Fairway Estates is a homeowners association (HOA) in Roseburg, AZ – a standard single-family home community. This document is a collection of board resolutions that set specific policies, not the full governing documents (CC&Rs, bylaws). The resolutions address fees, penalties, committee structure, and other administrative rules that bind all homeowners and their tenants/guests.
- Dues & late charges: Dues are set by the annual budget and payable quarterly in advance. Late payments incur a $15 fee per billing period if not received within 15 days of due date.
- Transfer fee: A $75 transfer fee is due to the association upon sale or transfer of a home. The selling owner must notify the association and provide escrow info. Also, an amount equal to one period's dues must be paid in advance by the new owner.
- Fines & enforcement: Violations: first offense gets a warning; second offense $100 fine; third $200 plus suspension of common area use; fourth leads to legal action. Noncompliance: after 10 days to correct, a $100 legal fee plus $100/month fine applies; after 3 months, legal action.
- Use of common areas & key deposits: Each new owner gets one free card key. Additional keys require a $50 deposit (refundable). Lost/damaged replacement costs $10. Written permission needed for renters to get keys. Late payment automatically suspends use of common areas (pool, clubhouse, etc.) and voting rights.
- Reserve fund: The association maintains a reserve fund for major repairs/replacements (clubhouse, pool, walls, landscaping, etc.). The board determines annual funding, and expenditures require board majority approval.
- Voting & records: Owners in good standing (dues current, no suspension) may vote via proxy or absentee ballot. Official pre-printed forms only. Records inspection allowed with 5 business days' notice; first 30 minutes free, then $50/hr for principal, $25/hr for staff; copies at city rate.
- Committees: Board-appointed committees include Violations, Nominating, Newsletter, Grounds, Architectural, and Activities. Each has defined duties; the Architectural Committee enforces architectural standards and can order cease-and-desist letters.
- What this document doesn't cover: These resolutions are only a partial set of rules. The full CC&Rs, bylaws, and any separately adopted rules and regulations (referenced but not included) may contain additional restrictions on pets, leasing, parking, age, etc. This document also does not address architectural standards specifics or the complete association budget.
