Black Buttes Well Co-Op is a non-profit water cooperative in Casa Grande, AZ, that owns and operates a shared well for a group of single-family residences. Each property gets one share in the co-op, which transfers with the land. The bylaws govern water service, fees, and maintenance of the well system.
- Membership & Shares: Each single-family residence in the co-op owns one share. Shares cannot be sold separately — they automatically transfer with the property. Share certificates are issued in duplicate.
- Fees & Billing: Monthly water fee is $25 per residence, due in advance on the first day of each quarter (so quarterly payments). The caretaker collects or owners can mail payment. A quarterly statement is sent showing each shareholder's balance, expenses, and the well account balance.
- Delinquency & Enforcement: If a payment is 60 days overdue, the co-op may take the shareholder to small claims court (shareholder pays court costs) and discontinue water service until all owed money plus a $100 fee is paid — only certified funds accepted.
- Water Usage Rules: Well water may only be used for bonafide domestic purposes. Initial and subsequent filling of pools costs $25. Sprinkler use is allowed on lawns. All current uses are grandfathered; new uses require shareholder vote. Shareholders must conserve water to ensure enough for all.
- Maintenance & Repairs: Repair or replacement costs over $500 require majority shareholder approval. If repair costs exceed the well account balance, the overage is split equally among shareholders. Each shareholder is responsible for leaks and damage on their own service line or plumbing. Damage caused by the owner or their contractors is also their responsibility. The co-op maintains water lines in established easements.
- Non-Participating Shareholders: Shareholders who have not developed their property and are not using the well retain voting rights but are not responsible for monthly payments. They are still responsible for share of maintenance expenses related to the well.
- Sewage Setback: No element of an individual sewage disposal system may be located within 100 feet of the well.
- Governance & Meetings: An annual business meeting is held each January. Special meetings can be called as needed. Each share has one vote; a simple majority decides matters. There is no elected board — a caretaker and an alternate are selected by rotation to oversee the well, collect fees, and handle the co-op's bank account (two signatures required for withdrawals). Bylaws can be amended at the annual meeting by majority vote, in person or by written proxy.
