It governs the shared use of driveways, parking, drainage, and utilities, along with landscaping, signage, and construction standards. These rules bind the lot owners and their tenants, and are intended for commercial development.
- Easements (cross access, parking, drainage, utilities): Grants nonexclusive perpetual easements for vehicular and pedestrian access, parking, storm water drainage, and public utilities across both lots. No walls or barriers may obstruct access, and each lot owner determines the exact location of its own easement areas.
- Maintenance & repairs: Each lot owner must maintain its own lot in good condition. If a lot owner fails to maintain its easement area after 30 days' written notice, the other lot owner may perform maintenance and charge the costs plus 10% annual interest.
- Design & construction approval: Prior to construction, lot owners must submit preliminary and final plans to the Declarant for approval. Plans are deemed approved if no objection within 30 days. Construction must conform to approved plans and any adopted design guidelines.
- Signage: Signs require Declarant's approval (deemed approved if no objection in 10 business days). Total signage area is separate per lot. Signs must not impair visibility of or access to any other lot.
- Insurance & liability: Each lot owner must maintain general public liability insurance of at least $1,000,000 covering its property, including the easement area. Each lot owner indemnifies the other for claims arising from its use of the easement area.
- Use restrictions: Lots must be used for lawful purposes consistent with similar developments. No outside merchandise display or vending machines without the other lot owner's consent. Hazardous substances are prohibited unless in compliance with all laws and approved by the adjacent lot owner.
- Environmental & hazardous substances: Each lot owner unconditionally indemnifies the Declarant and other lot owner for any loss, liability, or cleanup costs from a release of hazardous substances caused by that lot owner, its occupants, or permittees.
