This document does not set typical HOA rules; instead, it imposes fees and obligations on property owners to fund groundwater replenishment, ensuring an assured water supply for the community.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD, based on the parcel’s groundwater use, to fund groundwater replenishment obligations. The amount is set by CAWCD and includes a Replenishment Reserve Charge.
- Activation Fee: An Activation Fee must be paid to CAWCD by the owner before the state issues a public report allowing sale or lease of subdivided lots. The fee is per housing unit, as set by CAWCD.
- Replenishment Reserve Fee: For Category 1 member land, a one-time Replenishment Reserve Fee is due prior to issuance of a public report. It can be paid in cash or via long-term storage credits assigned to CAWCD.
- Lien & Personal Obligation: Unpaid Replenishment Assessments become a continuing lien on the parcel and a personal obligation of the owner at the time the assessment came due. CAWCD has legal remedies for nonpayment, including interest, costs, and penalties.
- Binding Effect & Amendments: The covenant runs with the land and binds all current and future owners. Amendments require written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area, or by changes in state statutes.
