- Permitted use: Lot 14 may only be used for a hotel and convention center. Changing the use requires Declarant approval, zoning compliance, and consideration of tenant exclusives.
- Architectural review: All construction, repairs, or exterior alterations on the hotel property require written approval from Declarant. Work must match the shopping center's architectural style and comply with all applicable laws.
- Prohibited uses: The hotel property is subject to a lengthy list of prohibited uses (e.g., adult businesses, auto repair, pawn shops, churches) and exclusive use restrictions in favor of certain shopping center tenants (e.g., PetSmart, Harkins Theatre).
- Parking: All parking for the hotel must be on its own property. The hotel must self-park and restrict guests from using shopping center parking, including signage and towing if needed.
- Maintenance & assessments: The hotel owner must pay monthly common area maintenance charges to Declarant, including a management fee up to 10% of costs, as detailed in the COREA. Payments begin after a certificate of occupancy is issued.
