What Mirage Heights Condominiums's governing documents say
This is the Condominium Declaration for Mirage Heights Condominiums in Fountain Hills, AZ. It defines the rights and obligations of unit owners in this 32-unit (expandable to 132) condominium community. The declaration sets rules for use of units, architectural changes, maintenance, and association assessments.
- Use restrictions: All units must be used as a single-family residence. No business, trade, or professional activity is allowed, though owners may keep a personal library or handle personal business correspondence from their unit.
- Architectural review: Nonstructural additions or alterations inside a unit don't need prior approval, but structural changes require written approval from the Architectural Committee and a licensed engineer. Any alteration visible from outside needs adjoining unit owner's approval. Solar panels, satellite dishes, and antennas visible from neighboring property are prohibited without advance written consent.
- Vehicles & parking: No motor vehicle may be constructed, reconstructed, serviced, or repaired on the property if visible from neighboring property. Inoperable vehicles cannot be stored or parked where visible.
- Nuisances & offensive activity: No nuisance or offensive activity is permitted. Exterior sound devices (speakers, horns, bells) are prohibited except for security or emergency devices.
- Maintenance responsibilities: The association maintains all common elements. Each unit owner maintains their unit and any limited common elements allocated to it (e.g., driveway, garage, patio). If an owner fails to maintain, the association may do so and charge the cost as a special assessment.
- Assessments: A common expense assessment is levied monthly per unit, initially capped at $140 per month. The board may increase this by the CPI change without a vote; any increase beyond that requires a 2/3 vote of unit owners. Special assessments may be levied as provided.
- What this document doesn't cover: This declaration does not address pet limits, leasing minimum terms, age restrictions, or specific parking space assignments. Those rules may be in other documents (bylaws, rules, or separate declarations).
