Rancho Jardines is a single-family home subdivision in Gilbert, AZ. These Covenants, Conditions & Restrictions (CC&Rs) run with the land and bind all owners. They set rules for lot use, building size, setbacks, fences, nuisances, and construction standards.
- Lot use & building type: Each lot is limited to one single-family dwelling unit. No house trailers (except recreational) or tents may be used as dwellings.
- Minimum home size & construction cost: Dwellings must have at least 1,600 square feet of floor area (excluding open porches, patios, garage/carport) and a minimum construction cost of $25,000 (labor and materials).
- Setbacks for main residence: Front walls must be at least 40 feet from the front property line; side walls at least 30 feet from side lines; rear walls at least 40 feet from the rear lot line.
- Fences: Fences must be wood, concrete block, pipe, or chain link (no barbed wire on street frontages). No solid wall, fence, or hedge over 3.5 feet tall within the front setback area. Maximum height 6 feet elsewhere.
- Nuisances, livestock & refuse: No noxious or offensive trade/activity. No hogs, goats, or similar livestock. No dumping of refuse; owners must dispose of garbage properly.
- Construction standards & timeline: All construction must use new first-class materials. Exterior surfaces must be finished or natural. Roofs cannot be tin, aluminum, or steel unless FHA-approved. Construction must be completed within 12 months of start (barring strikes, shortages, acts of God).
- Enforcement & duration: Violations can be enforced by the property owners association or any lot owner via injunction or damages, with attorney fees recoverable. These covenants run until June 1, 1994, then auto-renew for successive 10-year periods unless a majority of owners vote to change them during the 60 days before each renewal date.
