It requires property owners to pay an annual groundwater replenishment assessment to the Central Arizona Water Conservation District (CAWCD) to help secure a certified water supply for the development. The covenant runs with the land and creates a lien for unpaid assessments.
- Groundwater replenishment obligation: Each parcel is subject to a 'Parcel Replenishment Obligation' equal to the amount of groundwater delivered to the parcel times the percentage of excess groundwater used on the entire property. This obligation is used to calculate the annual assessment.
