This is a commercial property development in Mesa, AZ — the Commercial Center — governed by a Declaration of Covenants, Conditions, Restrictions and Easements. The rules apply to owners and occupants of commercial parcels (such as office, retail, or hotel uses). The development is also subject to the Superstition Springs Master Declaration, which may impose additional restrictions.
- Permitted & prohibited uses: Uses must be typical of commercial office, shopping center, or hotel projects. Hotels must have at least 100 rooms in a single building or connected group. Prohibited uses include auctions, bankruptcy sales, flashing lights or loudspeakers audible outside, burning trash, parking that obstructs traffic, and any unlawful activity.
- Architectural review & improvements: All new construction, remodeling, or exterior alterations require Declarant (Simmons Devcor) approval of Architectural Documents (plans, elevations, landscaping, signage, etc.). Declarant must respond within 15 days; failure to respond constitutes approval. Construction must be First-Class quality and comply with the Site Plan and Master Declaration.
- Maintenance & upkeep: Each owner must keep their parcel and improvements in a well-maintained, clean condition, including paved areas, landscaping, walls, sidewalks, and utilities. If an owner fails to maintain, Declarant can give 30 days' notice, then enter and perform work at the owner's expense, creating a lien on the parcel.
- Insurance requirements: Owners must carry comprehensive general liability insurance (at least $3,000,000 per occurrence), fire and multi-peril casualty insurance (100% replacement value), workers' compensation, and contractor's liability if applicable. Policies must be from insurers rated at least Best's A- XIII. Declarant must be named as an additional insured on liability policies.
- Parking & vehicle restrictions: Each owner must provide sufficient parking to meet City of Mesa requirements and prevent use of other parcels' parking by their users. No walls or barriers that obstruct traffic are allowed without consent. Delivery trucks and other vehicles must not unreasonably interfere with driveways or walkways.
- Reciprocal access & utility easements: All owners grant nonexclusive easements for ingress/egress, pedestrian movement, and utilities (water, sewer, electric, gas, telecom) over common areas. Utility installations must generally be underground. Owners must coordinate with each other and provide notice before construction affecting easements.
- Outdoor storage & waste management: Outdoor storage is prohibited except during construction or retail activities approved by Declarant. Waste containers must be commercial size, emptied at least weekly for putrescible waste, and screened from view by solid masonry walls. Loading areas must be paved and screened.
