What Lehi Shadows's governing documents say
Lehi Shadows is a single-family residential subdivision in Mesa, Arizona, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). These rules apply to all owners and occupants of the 24 lots and set requirements for home construction, property use, and the keeping of animals. The subdivision does not have a formal homeowners association; enforcement is by an Architectural Committee and individual lot owners.
- Use & Structures: Each lot is limited to one single-family residence of at least 2,000 sq ft of livable area (1,400 sq ft on the ground floor if multi-story). Roofing must be concrete tile, slate, or clay tile; wood or masonite siding is prohibited unless approved. No mobile homes, manufactured housing, or temporary living quarters are allowed. Construction must be completed within 270 days of commencement.
- Animals & Livestock: Lot owners may keep up to 5 chickens or fowl, and 2 sheep or goats per lot. Specified lots (3, 4, 9, 10, 15, 16, 21, 22) may keep one large animal (horse or cow) instead. No more than 2 dogs and 2 cats are permitted per lot. Swine, peacocks, geese, and guinea fowl are prohibited. Animal enclosures must be at least 40 feet from any neighbor's residence dining or sleeping area.
- Vehicles & Parking: Automobiles and pickup trucks not exceeding 3/4 ton may be parked on the side of a lot subject to setback and Architectural Committee approval. Campers, horse trailers, motorhomes, RVs, and boats may be parked only on the back quarter of the lot if screened and approved. Inoperable vehicles must be kept in an enclosed garage. Commercial vehicles are not allowed.
- Architectural Review: All construction, additions, alterations, and exterior color changes must be approved in advance by the three-member Architectural Committee. Plans (including site plan and landscaping plan) must be submitted with a fee (up to $75). The Committee has 30 days to approve or disapprove; failure to act within 30 days is deemed approval. Approved plans lapse after 12 months if construction has not started.
- Maintenance & Landscaping: Each lot must be kept free of weeds, debris, and unsightly items. Landscaping must be installed within 30 days of final inspection or 270 days of construction start, and maintained thereafter. Side and back yards must have a 6-foot cement/masonry block wall within 60 days of final inspection. Irrigation system repairs are shared by lot owners. If a lot owner fails to maintain, others may enter and clean, and the owner is liable for costs plus $75 and interest.
- Enforcement: Violations may be enforced by the Architectural Committee or any lot owner through legal action. The prevailing party is entitled to recover costs and attorney fees. Unpaid fines or costs may become a lien on the lot, which can be foreclosed like a deed of trust.
