The declaration binds property owners, lessees, and occupants to design standards, maintenance requirements, and pro-rata assessments for common area management. This is a commercial property document, not residential housing.
- Architectural Control & Design Review: All construction and exterior modifications require prior written approval from the Declarant. Applicants must submit detailed plans showing building height, materials, color, placement, landscaping, and signage; approval decisions are due within 30 days (deemed approved if Declarant does not disapprove within 15 days of a written demand). No metal buildings are permitted, though metal canopies for vehicles and metal parking structures may be allowed per design guidelines. No review fees are charged.
- Property Maintenance Standards: Each owner must maintain their parcel and all improvements to standards comparable to first-class industrial/office parks in metropolitan Phoenix. Landscaping must be irrigated, mowed, and trimmed regularly; dead plants must be promptly replaced. Vacant parcels must remain weed-free and neat. The Declarant can order corrective action on any parcel that appears neglected or detracts from the park; if the owner fails to comply, the Declarant can complete the work and place a lien on the property for the costs.
- Common Area Maintenance & Assessments: The Declarant maintains common areas including off-site improvements, signage, lighting, landscaping, sidewalks, and retention areas. Costs are shared among all owners as a pro-rata assessment based on land area, billed monthly or annually with a 30-day payment window. The Declarant's management fee cannot exceed 15% of total costs. Owners can dispute assessed amounts within 90 days of receiving a statement, and the Declarant must provide annual reconciliation within 150 days of fiscal year end.
- Easements & Utilities: The Declarant and utility providers have perpetual easements for water, sewer, electric, gas, telephone, fiber optic, and cable TV. In street areas, utilities must be installed below ground. In other areas, owner written approval is required (not to be unreasonably withheld) if the easement is at least 5 feet from existing improvements. Above-ground equipment like transformers and utility cabinets requires owner approval if it does not obstruct access or reduce parking spaces.
- Parking & vehicles: All parcels must provide self-parking in compliance with city code without off-site parking or variances. Parking standards must be maintained when buildings are altered, enlarged, or when uses change or intensify. On-street parking and parking in street areas is expressly prohibited and subject to penalty.
- Subdivision & Rezoning Restrictions: During the Declarant control period (until all Declarant parcels are sold or Declarant terminates the period in writing), no owner may further subdivide a parcel, convey less than all of a parcel, replat a parcel, or file a rezoning application without the Declarant's prior written approval. All improvements must be new construction; no structures may be moved from other locations onto a parcel.
- Damage & Destruction: If a building or improvement is damaged or destroyed, the owner must repair, rebuild, or demolish and remove all debris with diligence at their cost. Work must commence within 90 days of obtaining permits and insurance proceeds and be completed within 18 months. If the owner fails to act, the Declarant can demolish the structure at the owner's expense and place a lien on the property for recovery of costs.
