Mesquite Canyon is a single-family residential community in Mesa, AZ. You own your individual lot; the Association maintains common areas and enforces strict architectural, use, and vehicle standards through a community-wide declaration.
- What you own & maintain: You own your individual lot and any structures you build on it, subject to architectural approval. The Association owns and maintains common areas and can charge fees for recreational facilities.
- Architectural review & approval: Nearly all exterior changes—including landscaping, colors, materials, fences, and detached structures—require Architectural Committee approval. The Committee has broad discretion to refuse approval for aesthetic reasons; if it doesn't respond within 45 days, approval is deemed automatic.
- Single-family use & leasing: Your lot must be used exclusively for single-family residential purposes; no commercial or non-residential uses are allowed. Leasing to tenants is permitted, but only for terms of 30 days or longer (no short-term rentals), and tenants must agree to follow the Declaration and Association rules.
- Vehicles & storage restrictions: Most vehicles over 1 ton, trailers, boats, RVs, and aircraft cannot be parked or stored so they're visible from neighboring properties. Pickup trucks (≤1 ton, ≤7 ft tall) and mini motorhomes (≤7 ft tall, ≤18 ft long) may be kept in garages or driveways for regular transportation. Inoperable vehicles cannot be visible from neighboring property. Guest parking is limited to 12 consecutive hours per 48-hour period.
- Pets: A 'reasonable number' of domestic house or yard pets are permitted, kept solely as pets (not for commercial purposes) and without creating unreasonable noise or nuisance. No structures housing animals can be visible from neighboring property.
- Assessments & liens: Annual assessments began at $420/year per lot (as of 1999) and automatically increase each year by the greater of 5% or the Consumer Price Index. Initial buyers pay a one-time Capital Reserve Fee (one-sixth of the annual assessment) plus transfer fees at purchase. Delinquent assessments accrue 12% interest after 15 days and create a lien on the lot; the Association can foreclose if unpaid.
- Landscape & yard maintenance: Yards visible from the street must have landscaping installed within 180 days of purchase. All lots must be maintained free of weeds, debris, and dead plants or trees. Trash must be kept in covered containers and not visible except during collection.
