What 52nd Street Villas's governing documents say
52nd Street Villas is an 18-unit condominium in Phoenix, AZ (horizontal property regime), where you own your unit's interior and share ownership of the common building structure through a 1/18 undivided interest. The association, governed by a Board of Directors, maintains the common elements and collects assessments from all unit owners to cover costs.
- What you own & maintain: You own your unit's interior airspace (from unfinished floor to unfinished ceiling within the perimeter walls). The association maintains the shared structure (bearing walls, roof, foundation, building exterior, common parking, and grounds) and carries the master insurance.
- Assessments & fees: Each unit pays an annual maintenance assessment to fund common expenses. The Board can increase the annual assessment by up to 5% per year without a member vote, or by the Consumer Price Index formula, whichever is greater. Higher increases require a majority member vote. Unpaid assessments accrue 18% annual interest plus late charges and attorney fees.
- Parking: Each unit owner has the exclusive right to use one parking space. The Board assigns specific spaces and may reassign them at any time at its discretion.
- Common areas & amenities: You have an equal right to use all common grounds and recreational facilities shared by the community. The association may suspend your common-area privileges if assessments are unpaid or for rule violations (up to 60 days) and may charge reasonable admission or user fees.
- Membership & voting: Each unit owner holds one vote per unit in the association. Membership automatically transfers to a new owner when a unit is sold; you cannot transfer membership separately from the unit.
- Insurance: The association maintains multi-peril property coverage at 100% replacement cost, liability insurance (minimum $1 million per occurrence), fidelity bonds for officers/staff, and flood insurance if located in a hazard area. All insurance costs are common expenses paid by all owners.
- Board authority & management: The Board of Directors has broad power to set rules, assign parking, approve alterations, and establish policies. The Board's determinations on disputes or document interpretation are final and binding. A professional property manager may be hired but the agreement must be terminable for cause with 30 days' notice and cannot exceed three years.
