What Arcadia Green's governing documents say
Arcadia Green is a planned single-family home community in Phoenix, AZ, with an HOA (Arcadia Green Corporation). You own your lot and house, and the HOA owns and maintains the common elements (recreational facilities, streets, etc.). Memberships (shares in the corporation) come with each lot and are required for ownership.
- What you own & maintain: You own your lot and the house on it, plus exclusive use of assigned driveway and parking. The HOA maintains all common elements (landscaping, streets, pool, etc.) and carries master insurance on common buildings. You are responsible for interior utilities and insurance on your personal property.
- Leasing & rentals: The HOA has a right of first refusal on any lease of one year or longer — you must offer the lease to other members for 15 days first. Leases shorter than one year are exempt from this right and do not require board approval. There is no minimum lease term stated.
- Pets: Dogs, cats, or other household pets are allowed, but they cannot be kept, bred, or maintained for commercial purposes. No livestock or poultry.
- Business activities: No business activities of any kind may be conducted in any building or on the premises. One 'For Sale' or 'For Rent' sign of up to 5 square feet per parcel is allowed.
- Architectural review: Exterior additions, alterations, fences, hedges, or walls require written approval from the HOA's Board (architectural committee) for conformity and harmony with existing structures.
- Assessments: Each lot owner pays a pro-rata share (1/38) of the HOA's actual costs for common area maintenance, reserves, insurance, and other expenses. Charges are set annually and become a lien on the lot if unpaid after 20 days.
- Right of first refusal on sales & long-term leases: Before selling or leasing your lot for one year or longer, you must give the HOA written notice of the offer. Other members have 15 days to match the offer. If matched, you must sell or lease to the member. If not, you may proceed with the original offer within 60 days. Short-term rentals (under 1 year) are exempt from this right.
