Camelback Gardens Condominiums is a condominium community of 26 units in Phoenix, AZ — you own your individual unit plus an undivided 1/26th interest in the common areas. The association manages and maintains the common elements and enforces the rules, funded by assessments paid by all unit owners. This declaration is the primary rulebook for owners, occupants, and their guests.
- Use restrictions (Residential only): Each unit may be used only for single-family residential purposes; no trade or business is allowed (except for Declarant's model/sales office until all units are sold). No noxious, illegal, or offensive activities that disturb other owners are permitted.
- Pets: Usual household pets like dogs, cats, or birds are allowed but must be kept under reasonable control. The Board may adopt rules about pets, designate pet areas, and require removal if a pet becomes objectionable.
- Vehicles & parking: Trailers, campers, mobile homes, commercial vehicles, trucks (other than standard pickup), inoperable vehicles, boats, and off-road vehicles may not remain on the property except temporarily for loading/unloading or inside an enclosed garage/carport. Standard pickup trucks used for both business and personal use are allowed if commercial markings are unobtrusive.
- Signs & exterior alterations: Signs advertising a unit for sale or rent may be displayed only in locations designated by the Board and must be of reasonable size. No other signs are allowed without Board or Architectural Control Committee approval. Exterior clotheslines, external antennas, and alterations to the unit's exterior require prior written approval.
- Assessments & fees: All units share equally in regular annual assessments and special assessments (subject to a 20% cap per fiscal year without a 51% member vote). Annual assessments cannot increase or decrease by more than 50% from the prior year without a membership vote. Unpaid assessments accrue interest at 25% per annum and become a lien on the unit.
- Architectural review: No building, fence, wall, improvement, or alteration may be commenced without written approval from an Architectural Control Committee appointed by Declarant or elected by owners. This includes patios, awnings, carports, and other structures.
- Maintenance responsibilities: The association maintains all common areas (including parking, stairs, utilities, recreational areas). The unit owner is responsible for the interior of the unit and any damage caused by the owner or their guests. The association may enter a unit with notice to perform maintenance if the owner fails to do so.
