What Casas Bienvenidos Condominiums's governing documents say
This is the governing declaration for Casas Bienvenidos Condominiums, a 5-unit condominium community in Phoenix, AZ. It establishes the rights and obligations of unit owners regarding use, maintenance, governance, and fees.
- What you own & maintain: You own your unit's interior (walls, floors, ceiling finishes) and are responsible for its maintenance. The association maintains all common elements (e.g., roads, open spaces) and limited common elements like exterior doors and windows. Each unit's share of common expenses is equal (1/5).
- Assessments & fees: All units pay equal common expense assessments (1/5 each), set annually by the board. Payments can be monthly or quarterly. Delinquent assessments accrue 15% annual interest and are secured by a lien; the association can foreclose. A transfer fee (amount set by board) is due upon sale.
- Pets: Up to two 'Permitted Pets' (dogs, cats, or household birds under 30 lbs) are allowed. Dogs must be leashed outdoors and waste removed immediately. No pet structures visible from outside. The board may deem a pet a nuisance and require removal.
- Parking & vehicles: No trucks, trailers, campers, boats, or inoperable vehicles may be parked on the property. Vehicle repair is prohibited except for emergencies. The board may tow violating vehicles at owner's expense.
- Signs: No exterior signs allowed except a small name/address sign (max 6"x6") and temporary 'For Sale' or 'For Rent' signs (max 24"x36") on a real estate post (84"x42"). All other signs require board approval.
- Leasing & rentals: Leasing a unit is permitted and not considered a business. No minimum lease term is specified. Lessees have the right to use common elements during their tenancy, but the unit owner retains responsibility for compliance.
- Alterations & improvements: Nonstructural interior changes do not need board approval (but unit owner liable for damage). Structural alterations or any change visible from outside require prior board written approval. No changes to common elements without board consent.
- Insurance: The association carries property insurance on units and common elements (replacement cost), general liability (min $1M), worker's comp, directors & officers, and fidelity bonds. Unit owners may obtain their own policies for personal property and liability.
