This document is a set of deed restrictions (private covenants) recorded for a specific lot (Lot 2) in the Cinnabar Canyon II subdivision in Phoenix, AZ. It applies only to that lot and its owner, and is intended for the benefit of neighboring lots (Lots 3 and 4). These are not a full HOA rulebook but a limited set of restrictions running with the land.
- Minimum home size: Any home built on Lot 2 must have at least 1,500 square feet of livable area, exclusive of the garage.
- Building height limit: The maximum height of the structure at the highest point of the roof is 19.00 feet above a specified reference point (a brass cap in the center of the cul-de-sac on Mountain View Rd in Tract A, Cinnabar Canyon II).
- Landscaping restrictions: No trees or plants on Lot 2 may exceed a maximum height of 13.42 feet above the same reference point.
- Chimney allowance: A fireplace chimney may extend up to three feet above the highest point of the roof, provided the widest dimension of the exposed chimney above the roof is less than eight feet six inches.
- Enforcement: If the owner of Lot 2 violates any restriction, any person with an interest in Lots 3 or 4 may sue to enjoin the violation, remove any offending structure, and recover reasonable attorney's fees and costs.
- Amendments: The reversionary owner (a trust, per the document) may change these restrictions, but only with the approval of the owner of Lot 2.
