The community operates under Arizona's horizontal property regime law, with governing rules that establish owner rights, association powers, and use restrictions.
- What you own & maintain: You own your unit's interior (bounded by perimeter walls), windows, doors, electrical outlets, an appurtenant patio or balcony, and an exclusive parking space. You also hold a permanent, undivided percentage interest in all common areas. The association maintains the structure, roof, utilities, parking, and grounds; you are liable only for damage caused by your own act or negligence.
- Assessments & fees: Annual assessments are levied per unit based on your share of common areas and can increase or decrease up to 10% without a vote; beyond 10% requires 51% member approval. Special assessments for capital improvements are capped at 5% of budgeted expenses without majority vote. New buyers must pay 2 months' assessments at closing. - Architectural control & exterior changes: An architectural control committee (3–5 members, board-appointed) must approve in writing any exterior alterations, improvements, patios, landscaping, or structures before work begins. Patios and balconies cannot be used for storage or clotheslines, and all landscaping visible from streets or common areas requires committee approval.
- Use restrictions & conduct: Units are for single-family residential use only—no trade, business, or home occupation. No noxious, illegal, or offensive activities. Power equipment and car maintenance are prohibited except emergency or minor repairs under one day (which require board approval). Exterior clotheslines are not permitted.
- Assessment enforcement: Unpaid assessments create a lien on your unit that is superior to most other liens (except property taxes and first mortgages) and can be foreclosed.
