What Hayden Plaza East's governing documents say
This is a 2006 amendment to the original 1986 CC&Rs for the commercial/mixed-use subdivision Hayden Plaza East in Tempe, AZ. It deletes most of the original restrictions and dissolves the property owners' association, leaving the property governed primarily by city zoning and a separate common maintenance agreement (HPE-SRP). The amendment binds current and future owners of Lots 1, 2, and 3.
- What this amendment does: It removes nearly all of the original CC&R provisions, including the entire Article III (association), IV (uses), V (development standards), VI (landscaping), and VII, and deletes references to the now-dissolved Property Owners' Association and the Development Control Coordinator.
- Remaining restrictions: Uses must comply with the City of Tempe zoning ordinance; all improvements must comply with city regulations; landscaping must follow city-approved plans. Assessments are governed by a separate HPE-SRP Agreement and are based on square footage of parcels.
- What this document doesn't cover: This is only an amendment to the original CC&Rs, not the full set of rules. It does not contain details about pet limits, leasing, parking, or other common HOA rules—most of those were deleted. The original CC&Rs may still govern some matters not amended, but the text of this amendment does not specify what remains.
