Heritage Asante — Parcel 1 is a community of paired single-family townhomes in Phoenix, AZ, where two attached units share a common structural wall, each situated on its own lot. This supplemental declaration establishes specific rules for owners about property maintenance, front yard care, shared wall responsibilities, and cost-sharing.
- What you own & maintain: You own your unit to the center of the shared wall. You maintain your unit (including roof), driveway, pathway, the interior surface of the shared wall, and back/side yard. The association maintains and insures the front yard.
- Front yards: The association maintains your front yard; you pay a Special Service Area Assessment to cover maintenance, insurance, and capital reserves for repairs. You cannot alter, landscape, or decorate your front yard without prior written approval from the Architectural Committee.
- Shared wall ownership and maintenance: You and your neighbor each own to the center of the common wall and each maintain your side's interior surfaces (like painting). For major repairs or modifications beyond routine maintenance, you must obtain your neighbor's written consent, which cannot be unreasonably withheld.
- Repair costs for the shared wall: Major repairs or modifications cost 50/50 between you and your neighbor. If you damage the wall through your own action or negligence, you pay the full repair cost.
- Access to your neighbor's property: You have the right to access your neighbor's lot with reasonable advance notice to inspect and repair the shared wall or work on your own roof. In emergencies, you may access without notice. You must exercise due care not to harm their property.
- Payment deadlines and disputes: Bills for shared repairs are due within 30 days; unpaid amounts bear 10% annual interest. If you don't pay within 30 days, your neighbor can perform the work and bill you for actual costs. The Board makes binding decisions on disputes between owners.
